Abstract(s)
O presente trabalho de investigação aplicada encontra-se subordinado ao tema “Núcleos de Investigação de Crimes em Acidentes de Viação: Investigação, Condução do Processo e Decisão Judicial”, cujo objetivo geral é compreender se a análise levada a cabo pelos Núcleos de Investigação de Crimes em Acidente de Viação, no que diz respeito à investigação e exame de crimes em ambiente rodoviário, tem influência na decisão judicial.
Num primeiro momento, estudaram-se os Relatórios Finais realizados pelo Núcleo de Investigação de Crimes em Acidente de Viação do Comando Territorial de Castelo Branco e os respetivos despachos dos crimes de homicídios e de ofensa à integridade física por negligência, elaborados pela Autoridade Judicial. Esta análise procurou identificar ligações entre os dois documentos, ou seja, verificar em que aspetos os Relatórios são retomados nos despachos.
Para além disso, aplicaram-se inquéritos por entrevista a diferentes chefes do Núcleos de Investigação de Crimes em Acidente de Viação dos Comandos Territoriais, com vista a complementar a investigação realizada com a experiência e sabedoria daqueles que lidam com estas situações diariamente.
Pelo exposto, adotou-se uma estratégia de investigação qualitativa, e o tipo de abordagem utilizado foi um estudo de caso, realizado no Núcleo de Investigação de Crimes em Acidente de Viação do Comando Territorial de Castelo Branco.
Mediante os resultados obtidos, foi possível concluir que a investigação feita pelos Núcleos de Investigação de Crimes em Acidente de Viação exerce um papel essencial na investigação dos crimes rodoviários. Os mesmos conferem ao despacho final uma coerência e credibilidade sólida que, posteriormente, se reflete na decisão final.
Foi ainda apontado pelos militares entrevistados que, para que a investigação realizada pelos Núcleos de Investigação de Crimes em Acidente de Viação seja mais eficiente e eficaz, é necessário que seja fornecida mais formação, mais equipamento técnico e reforço de capacitação em recursos humanos .
This research work addresses the subject of “Traffic Accident Crime Investigation Units: Investigation, Conduct of the case and Court Decision”, and the main objective is to understand whether the analysis carried out by the Traffic Accident Crime Investigation Units, with regard to the investigation and examination of road crimes, has an influence on the court decision. The first step was to study the final reports of the Traffic Accident Crime Investigation Unit of the Castelo Branco Territorial Command and the corresponding court decisions for homicide and involuntary manslaughter issued by the court. This analysis sought to identify links between the two documents, in other words, to see which aspects of the reports were taken up in the criminal proceedings. Interviews were also conducted with various heads of the Traffic Accident Crime Investigation Units of the Territorial Commands, in order to add a better foundation to the research carried out based on the experience and wisdom of those who deal with these situations on a daily basis. A qualitive research strategy was adopted for this study, and the type of approach used was a case study carried out in the Traffic Accident Crime Investigation Unit of the Castelo Branco Territorial Command. From the results obtained, it can be concluded that the investigation carried out by the Criminal Investigation Department plays an essential role in the investigation of traffic crimes. They give a solid coherence and credibility to the final order, which is then reflected in the court decision. The soldiers interviewed also pointed out that, in order to make the investigation carried out by the Traffic Accident Crime Investigation Units more efficient and effective, it is necessary to provide more training, more technical equipment and more personnel.
