Não há dúvida que os últimos desenvolvimentos no domínio da inteligência
artificial já começaram a mudar a forma como o mundo percepciona esta tecnologia, sendo
impossível fingir que não existe. A União Europeia, preocupada com a indevida utilização
destes sistemas, desenvolveu um projecto de regulamento que pretende normatizar a forma
como todos os actores, públicos ou privados, a deverão usar. Uma das áreas cobertas é a
da ‘manutenção ordem pública’, desenvolvida pelas autoridades policiais, uma vez que
poderá colidir com os direitos, liberdades e garantias dos cidadãos. Apesar do esforço,
neste campo em específico, entendemos que a conceptualização, tal como é apresentada,
não garante uma boa aplicabilidade da norma nos Estados -Membros, pelo que neste breve
artigo se fazem algumas considerações a esse respeito, a título meramente exploratório.
There is no doubt that the latest developments in the field of artificial intelligence have already begun to change the way the world perceives this technology, and it is impossible to pretend that it doesn’t exist. The European Union, concerned about the improper use of these systems, has developed a draft regulation that aims to standardize the way in which all actors, public or private, should use it. One of the areas covered is the ‘maintenance of public order’, carried by the authorities, since it could conflict with citizens’ rights, freedoms and guarantees. Despite the effort made in this specific field, we believe that the conceptualization as it is presented does not guarantee good implementation of the rule in the Member States, which is why this brief article makes some considerations in this regard, purely on an exploratory basis.
