O Destacamento de Investigação Criminal: a concentração da IC nas unidades da Guarda

| dc.description.abstract | O objetivo deste estudo de caso é organizar a estrutura de Investigação Criminal (IC) da Guarda Nacional Republicana, ajustada à implementação de um Destacamento de Investigação Criminal, no contexto das Unidades Territoriais do Continente. Para estabelecer o modelo de análise foram definidos conceitos importantes para a compreensão desta investigação, sustentados nos normativos internos com impacto direto na organização da capacidade de IC da GNR, especialmente os graus de autoridade, os níveis de comando e as atribuições resultantes das funções de comando, de chefia, de estado-maior e de chefia técnica. A concentração de todas as vertentes da IC das Unidades Territoriais da Guarda no nível de comando de uma subunidade operacional afigura-se aparentemente simples de estruturar, integrando as atuais subsecções das Secções de Informações e de Investigação Criminal e dos Núcleos de Investigação Criminal dos Destacamentos, assegurando desta forma o princípio da “Unidade de Comando”, com um grau de autoridade de comando operacional. Da análise e discussão dos resultados, verifica-se que o afastamento dos Comandantes de Destacamento, em consequência do Despacho n.º 18/14-OG, associado à dependência funcional destes das Autoridades Judiciárias, como Autoridades de Polícia Criminal, não observará os princípios da descentralização e de proximidade preconizados na Estratégia da Guarda 2025. | pt_PT |
| dc.description.abstract | The objective of this case study is to organize the Criminal Investigation (CI) structure of the Republican National Guard, adjusted to the implementation of a Criminal Investigation Detachment, in the context of the Territorial Units of the Continent. To establish the analysis model, important concepts defined for the understanding of this investigation, supported by internal regulations with a direct impact on the GNR organization CI capacity, especially the degrees of authority, the levels of command and the attributions resulting from the functions of command, leadership, general staff, and technical leadership. The concentration of all aspects of the CI of the Territorial Units of the Guard in the level of command of an operational subunit seems simple to structure, integrating the current subsections of the Information and Criminal Investigation Sections and the Criminal Investigation Centers of detachments, thus ensuring the principle of the "Command Unit", with a degree of operational command authority. From the analysis and discussion of the results, it verified that the removal of Detachment Commanders, because of Order No. 18/14-OG, associated with the functional dependence of these Judicial Authorities, as Criminal Police Authorities, will not observe the principles of decentralization and proximity recommended in the Guard Strategy 2025. | pt_PT |
