Abstract(s)
A estratégia da Polícia de Segurança Pública 2020/2022 estabeleceu a necessidade de
continuamente se procurar uma cultura de excelência na prestação do serviço policial,
baseada na transparência, no cumprimento rigoroso dos protocolos policiais aprovados e no
respeito pelos direitos, liberdades e garantias dos cidadãos que servimos.
Este estudo que se produziu e que ultrapassou, em muito, os domínios da
regulamentação do processo penal, tratou exatamente disso.
Traduziu uma reflexão sobre a necessidade de um papel mais interventivo da
autoridade de polícia criminal na condução, supervisão e controlo da atividade processual
penal, em especial da investigação criminal, através do seu acompanhamento sistemático e
fiscalização e da comunicação, permanente e fluída, com a autoridade judiciária, baseada na
ideia de mútua confiança.
No percurso feito, interessou-nos concretamente compreender a evolução histórica e o
conceito atual daquela entidade mais qualificada, dentro dos órgãos de polícia criminal, a
sua contextualização teórica e concetual, elencar algumas contradições e inconsistências
existentes e propor diversas medidas, devidamente temperadas com o conceito de
exequibilidade, que permitissem ampliar, aprofundar e densificar as suas competências e,
dessa forma, melhorar a sua capacidade de chefia e comando.
The Public Security Police 2020/2022 strategy established the need to continuously seek a culture of excellence in police service delivery based on transparency, strict compliance with agreed police protocols and respect for the rights, freedoms and guarantees of the citizens we serve. This study, which went far beyond the areas of criminal procedure regulation, dealt with exactly that purpose. It reflected on the need for a more intervening role for the criminal police authority in the conduct, supervision and control of criminal procedural activity, in particular criminal investigation, through its systematic follow-up and monitoring and through permanent and fluid communication with the judicial authority, based on the idea of mutual trust. In the journey undertaken, we have been particularly interested in understanding the historical evolution and the current concept of the most qualified entity, within the criminal police bodies, its theoretical and concise contextualisation, listing some existing contradictions and inconsistencies and proposing various measures, duly tempered with the concept of feasibility, which would make it possible to broaden, deepen and densify its competences and, in this way, improve its leadership and command capacity.
