Este estudo teórico-reflexivo analisou a utilização de câmaras portáteis de uso individual pela Polícia de Segurança Pública, procurando responder em que medida a sua
adoção reforçou a transparência, o comando e controlo e a eficácia probatória sem comprometer a proporcionalidade e a privacidade. Recorreu-se a revisão integrativa de
literatura internacional e nacional, à análise do enquadramento normativo português recente e à comparação com experiências consolidadas. Sistematizaram-se benefícios (dissuasão de comportamentos desviantes, aumento da transparência e qualidade da prova, aprendizagem organizacional) e riscos (intrusão na vida privada, efeitos inibidores na cooperação cidadã, vulnerabilidades tecnológicas e de governação). Com base no teste tripartido da proporcionalidade, avaliou-se a idoneidade, a necessidade e a proporcionalidade em sentido estrito dos principais usos. Propôs-se um modelo de decisão operacional, com critérios objetivos de ativação, anúncio audível, gravação contínua durante a ocorrência, delimitação de acessos e prazos de conservação, auditoria e formação ética. Concluiu-se que, sob salvaguardas robustas de governação de dados e de controlo interno e externo, as câmaras portáteis puderam reforçar a transparência, o comando e controlo e a eficácia probatória, compatibilizando-as com a privacidade e os direitos fundamentais. Identificaram-se lacunas de evidência nacional e sugeriram-se linhas para avaliação empírica futura.
This theoretical-reflective study examined the use of body-worn cameras by the Portuguese Public Security Police, asking to what extent their adoption strengthened transparency, command and control and evidentiary effectiveness without undermining proportionality and privacy. An integrative review of international and national literature was conducted, the recent portuguese legal framework was analysed, and comparisons were made with mature foreign practices. Benefits were systematised (deterrence of deviant behaviour, increased transparency and quality of evidence, organisational learning) alongside risks (intrusion into private life, chilling effects on citizen cooperation, technological and governance vulnerabilities). Using the three-step proportionality test, suitability, necessity and proportionality stricto sensu were assessed across main use-cases. An operational decision model was then proposed with objective activation criteria, clear audible announcement, continuous recording during the incident, strict access and retention rules, auditing and ethics-centred training. It was concluded that, with robust data-governance safeguards and internal and external oversight, body-worn cameras could enhance transparency, command and control and the probative value of police action while remaining compatible with privacy and fundamental rights. Evidence gaps in the portuguese context were identified and avenues for future empirical evaluation were suggested.
