Abstract(s)
No âmbito do curso de Mestrado Integrado em Ciências Militares, na especialidade
de Segurança, deve ser realizado um Trabalho de Investigação Aplicada que, no presente
caso, subordina-se ao tema: “Utilização de Remotely Pilot Aircraft Systems pela GNR no
Contexto da Segurança- Impactos nos Direitos, Liberdades e Garantias dos Cidadãos”.
Para a realização desta investigação foi escolhido o modelo hipotético-dedutivo.
Deste modo, tendo em conta o método adotado, o presente trabalho procurou testar as hipóteses
de investigação previamente deduzidas, através das Perguntas Derivadas, às quais se
pretendeu dar respostas. Estas resultaram dos Objetivos Específicos e têm como finalidade
dar resposta à Pergunta de Partida resultante do Objetivo Geral desta investigação. Posto
isto, a metodologia aplicada neste trabalho de investigação, baseou-se principalmente em
Sarmento (2013), Quivy & Campenhoudt (2013) e em Fortin (2009, sendo que os
procedimentos adotados para a recolha de dados foram a análise documental, a pesquisa
bibliográfica, as entrevistas exploratórias e confirmatórias e a análise de dados.
Neste encalce, de forma a proporcionar um encandeamento lógico da investigação,
este trabalho está dividido em duas partes. A Parte I está dividida em quatro capítulos onde
é feito um enquadramento concetual da investigação, uma descrição da evolução dos
Sistemas de Aeronaves Pilotadas Remotamente, uma abordagem ao enquadramento legal
destes sistemas e à sua utilização pela Guarda. A Parte II está dividida em dois capítulos,
contemplando, a metodologia e procedimentos e a apresentação, análise e discussão de
resultados. Por fim, são tecidas as conclusões referentes à investigação realizada.
Da investigação desenvolvida, conclui-se que, para que haja um adequado equilíbrio
entre a utilização destes meios pela Guarda Nacional Republicana e o direito à privacidade,
é necessário verificar-se quatro pilares essenciais: mecanismos de comando e controlo operacionais
adequados, o fundamentalismo assente no elemento humano, existência de enquadramento
legal e procedimentos internos específicos para a utilização de sistemas de aeronaves
não tripuladas pela Guarda e, por fim, que exista mais cidadania no seio da sociedade.
In the course of the Integrated Master's Degree in Military Sciences, in the area of Safety, an Applied Investigation Paper must be carried out which, in the present case, is subordinated to the theme: “Utilização de Remotely Pilot Aircraft Systems pela GNR no Contexto da Segurança- Impactos nos Direitos, Liberdades e Garantias dos Cidadãos”. To achieve this investigation the hypothetical-deductive model was chosen. Considering the adopted method, the present paper tried to test the hypotheses of investigation previously deduced, through the Derived Questions, to which were intended to provide answers. These have resulted from the Specific Objectives and are intended to answer the initial question arising from the general objective of this research. The applied methodology in this research paper was mainly based on Sarmento (2013), Quivy & Campenhoudt (2013) and Fortin (2009), being that the adopted procedures for the data collection were documentary analysis, bibliographic research, exploratory and confirmatory interviews and data analysis. At this point in order to provide a logical linkage of the investigation, this paper is divided in two parts. Part I is divided into four chapters which provide a conceptual framework of the research, a description of the Remotely Pilot Aircraft Systems evolution, an approach to the legal framework of these systems and their use by the Republican National Guard. Part II is divided into two chapters, covering the methodology and procedures and the presentation, analysis and discussion of results. Finally, the conclusions regarding the research are presented. From the research carried out, it can be concluded that, in order to have an adequate balance between the Republican National Guard’s use of these means and the right to privacy, four essential pillars need to be verified: adequate operational command and control mechanisms, the fundamentalism based on the human element, existence of legal framework and specific internal procedures for the use of unmanned aircraft systems by the Republican National Guard and, finally, the existence of more citizenship within society.
