Abstract(s)
As imagens, por vezes obtidas de forma ilícita, colocadas a circular nas redes sociais podem nos dias de hoje consubstanciar-se num excelente meio de prova, de forma a fazer-se justiça. O carácter intrinsecamente probatório da prova, mesmo que seja ilícita nunca deixa de existir, pelo que podemos dizer que continua a conter em si uma, possível, solução da investigação e consequente processo.
Num Estado de direito Democrático a salvaguarda da dignidade da pessoa é essencial, sendo mesmo um objectivo, a par da realização da justiça/descoberta da verdade. A realização da justiça e a descoberta da verdade e a salvaguarda dos direitos fundamentais podem ser, em processo penal, conflituantes entre si. A procura da concretização de uma finalidade, por vezes, suprime-se a outra.
Os direitos fundamentais não são absolutos, podendo ser limitados, mas sempre, de acordo com princípio da proporcionalidade. A protecção penal é um direito e dever fundamental de um Estado. Por conseguinte, o regime da Prova garante que os direitos individuais sejam, dentro do possível, os menos afectados/lesados.

The inherently probationary aspect of evidence, even though it's illegally provided, never cease to exist, so we can confirm that continues to be one possible solution of the investigation. In a Democratic Estate, Human Dignity is essential, becomes an objective itself, as well as justice's realization/discover of truth. The justice's realization and the discovery of truth can have, as the protection of fundamental rights in the criminal procedure, conflicting points between themselves. In order to reach the realization of one of them, sometimes, others are put behind. The fundamental rights are not absolute because they can be limited, always according to the issue of proportionality. Criminal protection is a Fundamental Right and one of the tasks of State. Therefore, the proof's regime assures that individual rights are, as much as possible, the least affected.
