Abstract(s)
O desporto é um direito fundamental da vida em sociedade e está consagrado em
vários diplomas nacionais e internacionais, tendo inclusive proteção constitucional. Não
obstante, a base normativa interna, apesar de recente, tem estado em constante mutação.O
presente artigo tem como objetivo central identificar e refletir acerca do regime legal
vigente de algumas entidades desportivas nacionais, nomeadamente das federações
desportivas e associações territoriais de clubes. A metodologia de investigação
implementada reside num estudo de revisão crítica da literatura, onde se analisam as fontes
que caraterizam o problema para posterior clarificação e integração das mesmas. Após
análise do quadro legal que regulamenta esta temática, verificou-se que algumas entidades,
como as federações desportivas e ligas profissionais, emanam puros atos administrativos
em resultado do estatuto de pessoa coletiva de utilidade pública desportiva, não se
aplicando este estatuto às associações territoriais de clubes, onde se inserem as associações
distritais ou regionais desportivas. Não obstante, este último tipo de associações subsistem
na operacionalização dos poderes disciplinares, muitas vezes com a anuência explícita por
parte das federações nos respetivos estatutos, sendo tal procedimento de duvidosa
legalidade.

Nevertheless, the internal normative basis, although recent, has been constantly changing. The main objective of this article is to identify and reflect on the current legal regime of some national sports entities, namely sports federations and territorial sports associations. The research methodology implemented is based on a critical review of the literature, where the sources that characterize the problem are analyzed for later clarification and integration. After analyzing the legal framework that regulates this subject, it was verified that some entities, such as sports federations and professional leagues, emanate pure administrative acts as a result of the status of public sport public utility, not applying this status to territorial sports associations, where are included district or regional sports associations. Nevertheless, this type of associations still applying disciplinary powers, often with the explicit consent of the sports federations in their statutes, being such procedure of doubtful legality.
