Abstract(s)
As relações laborais encontram-se em transformação. A mutação das relações laborais, a individualização, as formas atípicas de emprego, o enfraquecimento da negociação colectiva, o declínio da sindicalização, as novas dinâmicas e tendências do sistema das relações laborais são espelhadas nas decisões que o Tribunal é chamado a proferir.
O estudo aqui apresentado permitiu abordar estas transformações analisando as decisões proferidas pelos Tribunais do Trabalho na medida em que estes têm um papel na regulação das relações laborais. Através do estudo do caso do Tribunal do Trabalho de Setúbal e analisando a sentenças ali proferidas no ano de 2013 avaliamos o seu papel nas relações laborais na região de Setúbal, concluímos que a maior percentagem de decisões recai sobre contrato individual de trabalho, acidentes de trabalho e contra ordenações.
The changes in labour relations such as the increasing individualization of the labour relations, the proliferation of atipical forms of employment, the weakening of collective bargaining, the decline of unionization the new dynamics and system trends of industrial relations are mirrored in the decisions that the Court makes. The study presented here dealing with the subject of these changes by analyzing the decisions handed down by the Labour Courts in that they have a role in regulating labor relations. Through the case study of Setúbal Labour Court and analyzing sentences passed there in 2013 evaluated its role in labour relations in the Setúbal region concluded that the highest percentage of decisions rests with individual contract of employment, occupational accidents and administrative offenses.
