O Tráfico Ilícito de Estupefacientes e Substâncias Psicotrópicas, é um dos mercados
mais dinâmicos e adaptativos praticados pela via marítima. Constitui-se como uma ameaça
para a saúde individual dos povos, atingindo com efeitos nocivos o desenvolvimento
económico e social da humanidade.
O regime jurídico do Alto Mar, através da Convenção de Montego Bay de 1982,
confere princípios de liberdade de navegação para os Estados, devendo o exercício desta
liberdade ser utilizado para fins pacíficos. Estes pressupostos, dão lugar a uma
consciencialização de reduzida capacidade de intervenção dos Estados, acabando por
eventualmente favorecer a prática de ilícitos em Alto Mar.
No Direito Internacional, a celebração de convenções, acordos e tratados pelos
Estados, constitui um indicador evidente de que, no amplo domínio das atividades ilícitas
que integram o crime organizado, existe ainda um grande potencial na capacidade de
intervenção. Contudo, torna-se indispensável a continuidade de uma coordenada cooperação
evolutiva entre Estados, assim como uma atualização adaptativa de todo um quadro jurídico,
que por si só, consiga fazer face ao Tráfico Ilícito de Estupefacientes e Substâncias
Psicotrópicas em Alto Mar.
Abstract: The Illicit Trafficking of Narcotic Drugs and Psychotropic Substances is one of the most dynamic and adaptive markets practiced by the sea. It constitutes a threat to the individual health of the peoples, affecting with detrimental effects the economic and social development of humanity. The legal status of the High Seas, through the Montego Bay Convention of 1982, confers the principles of freedom of navigation for States, and the exercise of that freedom should be used for peaceful purposes. These presuppositions give rise to an awareness of the reduced capacity of intervention of the States, eventually favoring the practice of illicit activities in the High Seas. In international law, the conclusion of conventions, agreements and treaties by States is an obvious indicator that, in the broad field of illicit activities that comprise Organized Crime, there is still a great potential in intervention capacity. However, it is essential to ensure the continuity of a coordinated evolutionary cooperation between States, as well as an adaptive updating of a whole legal framework that, in itself, can deal with illicit trafficking in Narcotic Drugs and Psychotropic Substances on the High Seas.
