Este estudo prende-se com a delimitação e destrinça da relação existente entre a Polícia de
Segurança Pública (PSP) e o Ministério Público (MP), no que concerne à fase processual
penal do Inquérito. A direção do Inquérito cabe ao MP, assistido pelos órgãos de polícia
criminal (OPC). Como ponto de partida deste estudo, analisou-se, en passant, a história e
as opções tomadas no processo penal português, esmiuçando, logo após, em que moldes é
feita a direção do Inquérito e a delegação de competências nos OPC, sem olvidar o âmbito
da iniciativa própria da PSP – as medidas cautelares e de polícia. Finalmente pudemos
identificar o estado atual da relação MP-PSP e que vulnerabilidades existem que desviam
estes órgãos do cumprimento das suas missões. Foram sinalizadas tarefas saturantes que
implicam o empenho de consideráveis efetivos policiais e que tomam tempo que deveria
ser dedicado à coadjuvação efetiva do MP. Foram, ainda, identificados os inconvenientes
na relação MP e PSP e foram lançados novos paradigmas de relacionamento, que passam
por uma relação de complementaridade e indissociabilidade – delinear de estratégias
comum, com resultado numa condução estratégica focada na especialização de cada um e
no estreitamento da ligação funcional de ambos.
This study concerns the delimitation and distinction of the relationship between the Polícia de Segurança Pública (PSP) and the Public Prosecutor's Office, regarding the criminal procedural phase of the Inquiry. The direction of the inquiry is the responsibility of the Public Prosecutor's Office, assisted by the police criminal organs. As a starting point for this study, we have analyzed, the history and the options taken in the portuguese criminal procedure, detailing in what ways the management of the Inquiry and the delegation of powers to the police criminal organs is made, without forgetting the scope of the PSP's own initiative. Finally, we were able to identify the current state of the relationship between the Public Prosecutor's Office and the PSP and what vulnerabilities exist that divert these bodies from fulfilling their missions. We were able to identify saturating tasks that require the commitment of considerable police personnel and that take up time that should be devoted to assisting the Public Prosecutor's Office. Inconveniences in the relationship between the Public Prosecutor's Office and the PSP were also identified and new paradigms of relationship were launched, which include a complementary and inseparable relationship - drawing up common strategies, resulting in a strategic conduct focused on the specialization of each one and on the strengthening of the functional connection between both.
