Abstract(s)
O presente estudo tem como objeto o comportamento das munições menos letais com
projéteis de bagos de borracha em uso na Polícia de Segurança Pública. Esta temática
sempre atual, conflitua com o direito legalmente atribuído às forças de segurança de
recorrer à força para repor a ordem pública e os princípios fundamentais inerentes à
atividade policial, mais propriamente o princípio da legalidade, necessidade,
proporcionalidade e proibição do excesso. Para a materialização do trabalho, foi feito um
estudo de natureza empírica, que através do recurso a materiais e técnicas cientificamente
comprovadas para o efeito, foi possível recolher dados significativos relativamente às
distâncias, precisão, dispersão e efeitos provocados no alvo (a denominada balística
terminal ou dos efeitos) das munições menos letais. Foi também feita uma comparação
entre estas munições e outras duas munições menos letais em uso em algumas polícias
internacionais, no intuito de buscar a munição com as características mais adequadas para
empregar em cenários de desordem e reposição da ordem pública. No final são perpetuadas
algumas considerações relativamente aos resultados obtidos e feitas algumas propostas de
continuidade do presente estudo uma vez que são escassos os trabalhos científicos que
abordam a temática das munições de baixa potencialidade letal.
The present study has as object the effect of the less lethal ammunitions with rubber pellet projectiles in use by the Polícia de Segurança Pública. This always current theme conflicts with the legally right attributed to the law enforcement authority’s to use force in order to restore public order and the fundamental principles inherent to police activity, more specifically the principle of legality, necessity, proportionality and prohibition of excess. In order to materialise this work, an empirical study was carried out, which, through the use of materials and techniques scientifically proved for that purpose, it was possible to collect significant data regarding the distances, accuracy, dispersion and effects caused on the target (the so-called terminal ballistics or effects) of the less lethal ammunitions. A comparison was also made between these munitions and two other less lethal munitions in use in some international police forces, in order to find the munition with the best characteristics to be used in scenarios of disorder and restoration of public order. At the end, some considerations are made regarding the results obtained and some proposals for the continuation of this study are made, since there are few scientific papers addressing the issue of low-lethal ammunition.
