Abstract(s)
A suspensão do processo disciplinar é um instituto jurídico introduzido há três anos
no Estatuto Disciplinar da Polícia de Segurança Pública. Assim, o presente estudo teve
como principal objetivo conhecer a percentagem de aplicabilidade da suspensão do
processo disciplinar, bem como a origem do seu proponente, em sede do respetivo
processo e ainda as injunções e regras de conduta associadas e cumpridas pelos arguidos.
O método utilizado para a recolha dos dados consistiu na aplicação de um questionário de
resposta fechada, aos Chefes dos Núcleos de Deontologia e Disciplina, do Comando
Metropolitano do Porto, do Comando Regional dos Açores e do Comando Distrital de
Faro. Através de uma análise descritiva dos resultados viemos a concluir que efetivamente
a suspensão do processo disciplinar foi aplicada a 8,4% do total dos processos instaurados,
sendo a esmagadora maioria das vezes proposta a sua aplicação pelo respetivo instrutor. O
estudo permitiu-nos ainda conhecer as regras de conduta e injunções que têm vindo a ser
aplicadas e abriu um interessante caminho para a realização de estudos mais aprofundados,
com vista a conhecer em maior detalhe as vantagens da aplicação deste instituto e os seus
consequentes efeitos positivos.
The suspension of disciplinary proceedings is a legal institute introduced about three years ago in the Disciplinary Statute of the Public Security Police. Thus, the main objective of the present study had as to know the percentage of applicability of the suspension of the disciplinary proceedings, as well as the origin of its proponent, in the respective proceedings, and also the injunctions and rules of conduct associated and complied with by the defendants. The method used to collect the data consisted in the application of a closedended questionnaire to the Heads of the Deontology and Discipline, Units of the Metropolitan Command of Oporto, the Regional Command of Azores and the District Command of Faro. Through a descriptive analysis of the results, we concluded that the suspension of the disciplinary process is effectively was applied to 8,4% of the total number of cases opened, with the overwhelming majority of the cases being proposed by the respective instructor. The study also allowed us to understand the rules of conduct and injunctions that have been applied and opened a interesting path for further studies, with a view to knowing in greater detail the advantages of applying this legal disciplinary institute and its consequent positive effects.
