O presente Trabalho de Fim de Curso visa analisar o posicionamento do direito
fundamental de Reunião e Manifestação de Portugal no contexto ibérico, assim como
valorizar a sua postura perante o Direito da União Europeia, para determinar o nível de
garantia e proteção deste Direito em Portugal.
O método de investigação baseou-se em uma análise das Constituições portuguesa e
espanhola, os Tratados constituintes da União Europeia, as leis nacionais de aplicacação, e
finalmente, a literatura de interesse para o estudo, abundante e específica, o que colaborou
para a melhor sustentação das conclusões.
Os resultados da investigação demonstraram a proximidade das diferentes ordens
jurídicas analisadas, com muitos puntos de convergência na conceição e na regulação do
Direito de Reunião e Manifestação, nomedadamente entre o direito português e o espanhol,
além de fornecerem a conclusão principal do estudo em apreço, que estabelece que o Direito
de Reunião e Manifestação português é um garante dos direitos e liberdades preconizados
na Declaração Universal dos Direitos Humanos, constituindo-se como um precursor de
outros direitos relacionados com a matéria, como o direito espanhol, razão pela qual deve
ser tomado como um exemplo.
The present End-of-Course Work is intended to analyse the position of the Fundamental Right of Assembly and Demonstration in an Iberian context, and to value it also within the legal framework of the European Union, to determine the level of guarantee and protection of this Right in Portugal. The investigation method was based firstly in an analysis of both Portuguese and Spanish Constitutions, the Treaties of the European Union, the national laws regulating the subject, and finally, the literature of interest for the Work, specific and varied, which collaborated to the support of the conclusions. The results of the investigation showed the proximity of the different legal bodies, providing several points of convergency regarding the concept and the regulation of the Right, mainly between the Portuguese and the Spanish Right, moreover to facilitate the obtention of the main conclusion of the Work, which establishes that the Portuguese Right is guaranteer of Rights and Liberties covered by the Human Rights Universal Declaration, becoming a percursor of other related Rights, such as the Spanish, so this Right is to be taken as an example.
