Abstract(s)
O bloco legislativo que combate a violência associada ao desporto reserva formas distintas
de sancionamento das condutas não compagináveis com uma participação pacífica e segura
em eventos desportivos, punindo determinados comportamentos como crime e outros
como contraordenação. O legislador, respeitando os princípios da intervenção mínima e da
subsidiariedade, deve apenas socorrer-se dos instrumentos repressivos de Direito Penal
quando o mesmo fim não se consegue atingir por mecanismos menos lesivos dos direitos
fundamentais dos cidadãos. Neste sentido, a descriminalização de condutas no âmbito da
violência associada ao desporto possibilita a atuação da Autoridade para a Prevenção e o
Combate à Violência no Desporto, autoridade administrativa que se assumiu como
entidade de referência na prevenção e combate deste fenómeno. Os resultados apresentados
no que ao sancionamento dos adeptos prevaricadores diz respeito, nomeadamente aquando
da introdução e utilização de determinados artigos de pirotecnia, despertou o nosso
interesse, levando-nos ainda a perspetivar se outras condutas, como a invasão da área do
espetáculo desportivo, poderiam seguir a via da descriminalização. Concluímos que
subsistem razões para uma mudança da natureza punitiva, o que pode trazer vantagens na
eficácia do regime sancionatório e contribuir para a redução do sentimento de impunidade.
The legislative block that combats violence associated to sport reserves distinct ways of sanctioning conducts that are not compatible with a peaceful and safe participation in sport events, punishing certain behaviours as a crime and others as a misdemeanour. The legislator, respecting the principle of minimum intervention and subsidiarity, should only resort to repressive instruments of Criminal Law when the same end cannot be reached by less damaging mechanisms of the fundamental rights of citizens. In this sense, the decriminalisation of conducts in the scope of violence associated to sport enables the performance of the Authority for the Prevention and Combat of Violence in Sport, an administrative authority that has assumed itself as a reference entity in the prevention and combat of this phenomenon. The results presented regarding the sanctioning of prevaricating supporters, namely when certain pyrotechnic articles are introduced and used, aroused our interest, also leading us to consider whether other conducts, such as the invasion of the area of the sports event, could follow the path of decriminalisation. We conclude that there are reasons for a change in the punitive nature, which may bring advantages in the effectiveness of the sanctioning regime and contribute to reduce the feeling of impunity.
