Abstract(s)
A presente investigação, intitulada “A Investigação Criminal na Guarda Nacional Republicana no combate a casos de Violência Doméstica e Maus Tratos em Idosos no Comando Territorial de Lisboa”, tem como objetivo analisar a atuação dos militares face aos crimes de violência doméstica e maus tratos nos idosos, designadamente as capacidades da investigação criminal desta força de segurança.
Nesta ótica, analisou-se o estado da arte para melhor compreender a problemática em causa, elaborar o enquadramento teórico e definir o modelo de análise. Posteriormente, a recolha de informação relativa ao trabalho de campo recorreu à realização de inquéritos por entrevista e à aplicação de inquéritos por questionário. Desta forma, a abordagem é mista. Visto que o Comando Territorial de Lisboa foi o foco do estudo, esta investigação é um estudo de caso quanto à estratégia metodológica utilizada.
Os casos de Violência Doméstica e Maus Tratos contra idosos no Comando Territorial de Lisboa apresentam características bem definidas. As principais vulnerabilidades incluem a dependência financeira e emocional dos agressores, o isolamento social e a falta de autonomia dos idosos. A vergonha que as vítimas sentem em denunciar os próprios familiares às autoridades policiais dificulta a ação policial. Deste modo, evidencia-se a complexidade da questão e a necessidade de abordagens integradas e sensíveis para prevenir e mitigar essas situações.
Verificou-se que os militares da Guarda Nacional Republicana, tanto os patrulheiros quanto os dos Núcleos de Investigação e Apoio a Vítimas Específicas, adotam procedimentos específicos, adaptados a estas vítimas específicas. No entanto, alguns pontos fracos foram identificados, como o défice de recursos humanos com formação na área e a falta de acompanhamento do apoio especializado em todas as situações. Para melhorar a resposta a este tipo de crimes, sugere-se uma maior sensibilização e capacitação dos recursos humanos, bem como o reforço de protocolos institucionais fortes e coesos para garantir uma atuação mais eficaz e adaptada às necessidades das vítimas.
The present investigation, entitled "Criminal Investigation by the National Republican Guard in Combating Domestic Violence and Elder Abuse Cases in the Lisbon Territorial Command," aims to analyze the actions of military personnel in response to crimes of domestic violence and elder abuse, particularly the criminal investigation capabilities of this security force. In this regard, the state of the art was analyzed to better understand the issue at hand, develop the theoretical framework, and define the analysis model. Subsequently, information collection for the fieldwork involved conducting interviews and administering questionnaires. Thus, the approach is both qualitative and quantitative, respectively. Since the Lisbon Territorial Command was the focus of the study, this investigation is a case study concerning the methodological strategy employed. Cases of Domestic Violence and Elder Abuse in the Lisbon Territorial Command exhibit well-defined characteristics. The main vulnerabilities include financial and emotional dependence on the abusers, social isolation, and lack of autonomy among the elderly. The shame victims feel in reporting their own family members to the police hinders police action. Therefore, the complexity of the issue is evident, as well as the need for integrated and sensitive approaches to prevent and mitigate these situations. It was found that Guarda Nacional Republicana officers, both patrollers and those from Núcleo de Investigação e Apoio a Vítimas Específicas, adopt specific procedures tailored to these specific victims. However, some weaknesses were identified, such as a shortage of human resources trained in this area and the lack of follow-up with specialized support in all situations. To improve the response to this type of crime, greater awareness and training of human resources are suggested, as well as the strengthening of strong and cohesive institutional protocols to ensure more effective actions tailored to the needs of the victims.
