Abstract(s)
A proteção à fauna e flora está prevista constitucionalmente no Brasil, explicitamente na
Constituição Federal de 1988. Por meio deste diploma foram desencadeadas discussões no
tocante à proteção aos animais e seu status jurídico. Todavia, apesar de transcorrido grande
lapso desde 1988 a proteção aos animais ainda está em discussão, em busca de um caminho
que lhe assegure as prerrogativas previstas. Nota-se que o presente estudo tem o condão de
verificar, sem obviamente esgotar o tema, se existe alguma desconformidade entre as
representações sociais e o quadro jurídico de proteção dos animais, em vigor; se a aplicação
da proteção jurídica aos animais está adequada às exigências da sociedade, bem como
preconizado legalmente; e, em conformidade com a tutela jurídica dos direitos fundamentais.
Para o fim de se destacar esta temática realizou-se, um trabalho de campo, entrevistando
pessoas comuns, escolhidas com critérios mínimos que pudessem representar o modo de
pensar da sociedade atual, com o fito de apurar a consciência coletiva/individual acerca da
titularidade dos direitos fundamentais pelos animais, além de estudo doutrinário, legislativo e
jurisprudencial, com o escopo de verificar conclusivamente a temática principal do trabalho,
ou seja, se a titularidade dos direitos fundamentais pelos animais é uma realidade ou não
segue além de mera ficção jurídica.
The protection of fauna and flora is constitutionally envisaged in Brazil, explicitly in the Federal Constitution of 1988. Through this diploma, discussions were initiated regarding the protection of animals and their legal status. However, despite a long lapse since 1988 the protection of animals is still under discussion, in search of a path that will ensure the prerogatives foreseen. It is noteworthy that the present study has the ability to verify, without obviously exhausting the theme, if there is any disagreement between the social representations and the legal framework of animal protection, in force; whether the application of legal protection to animals is adequate to the requirements of society, as well as legally advocated; and in accordance with the legal protection of fundamental rights. In order to highlight this theme, a field work was carried out, interviewing ordinary people, chosen with minimum criteria that could represent the way of thinking of the current society, with the purpose of ascertaining the collective / individual consciousness about the ownership of the fundamental rights for animals, as well as a doctrinal, legislative and jurisprudential study, with the scope of conclusively verifying the main theme of the work, that is, whether the ownership of fundamental rights by animals is a reality or does not follow beyond mere legal fiction.
