Abstract(s)
O tema do presente trabalho é: “O papel do Serviço de Proteção da Natureza e do
Ambiente (SEPNA) nas infrações de mera ordenação social ambiental”.
Em 2001 surgiu a criação numa força policial, nomeadamente, na Guarda Nacional
Republicana (GNR), um serviço especializado para a proteção da natureza e do ambiente
através do protocolo entre o Ministério da Administração Interna (MAI) e o Ministério do Ambiente e do Ordenamento do Território (MAOT). Desta forma, o SEPNA constitui-se
como a primeira polícia ambiental do país, com competências para vigiar, fiscalizar, noticiar e investigar as inúmeras infrações à vasta legislação que visa a proteção da natureza, do ambiente e de todo o património natural.
Visto que, um estudo geral da problemática ambiental seria demasiado abrangente,
decidiu-se restringir o trabalho a uma análise do papel desempenhado pelo serviço criado na GNR relativamente às infrações de mera ordenação social, deixando de lado, a parte respeitante a ilícitos criminais. Assim, o presente trabalho tem como principal objetivo averiguar o trabalho desenvolvido pelo SEPNA na aplicação de contraordenações ambientais desde a sua criação até ao momento, assim como, analisar a relevância deste.
Considerou-se importante também referir, através das áreas de atuação definidas ao SEPNA, qual o tipo de contraordenações mais cometidas a nível nacional, identificando-as geograficamente por distritos.
A recolha dos dados necessários para atingir os objetivos propostos é suportada pela análise documental dos resultados da atividade operacional do SEPNA, e pela realização de um conjunto de entrevistas semidiretivas a uma amostra, que se encontra
escalpelizada na metodologia do trabalho de campo.
Após a análise dos resultados da investigação, conclui-se principalmente que a criação do SEPNA foi claramente importante para a melhoria da política ambiental em Portugal, através da missão desenvolvida por este, a questão ambiental ficou mais acentuada na consciência da população, estando atualmente mais atenta para os problemas que podem advir de uma má conduta ambiental. Embora existam certas limitações, em termos de recursos humanos e materiais, este serviço criado especialmente para tratar da temática ambiental no país continua a executar da melhor forma possível a sua missão através da sensibilização, prevenção e fiscalização de ilícitos ambientais.
Abstract The theme of this work is: "The Role of the Protection of Nature and Environment Service (SEPNA) on violations of environmental regulatory law." In 2001, a specialized service for the protection of nature and the environment was created in the National Republican Guard (GNR) by the Protocol between the Ministry of Internal Affairs (MIA) and the Ministry of Environment and Territory Planning (METP). Thus, the SEPNA became the country's first environmental police, with powers to oversee, monitor, report on and investigate the numerous violations of comprehensive legislation aimed at the protection of nature, the environment and its natural heritage. Since a general study of environmental problems is too extensive, it was decided to restrict the work to an analysis of the role played by the GNR service created in relation to offenses under a regulatory law, leaving aside the part concerning malpractices. Thus, the present work has as a main objective to determine the work done by SEPNA the study of environmental offenses since its inception to date, as well as to analyze the relevance of this. It was considered important to note, through the practice areas defined at SEPNA, what type of offenses committed more nationally, identifying them geographically by district. The collection of data needed to achieve the proposed objectives is supported by documentary analysis of the results of the operating activity of SEPNA, and the realization of a set of semi-directive interviews with a sample, which is described in the methodology of fieldwork. After analyzing the research results, it is concluded that the creation of mainly SEPNA was clearly important to the improvement of environmental policy in Portugal, through the mission developed by this, environmental issues became more pronounced in the consciousness of the population, currently more attentive to the problems that can arise from poor environmental conduct. Although there are certain limitations in terms of human and material resources, this service specially created to address environmental issues in the country continues to perform its mission optimally through awareness, prevention and enforcement of environmental offenses.
