| dc.description.abstract | A natureza e a dimensão da criminalidade organizada, sem território definido e sem fronteiras, num espaço de livre circulação de pessoas, bens, serviços e capitais vieram exigir novas respostas na política criminal da União Europeia dando primazia à cooperação judiciária e policial e ao reconhecimento mútuo ao serviço da liberdade e segurança num espaço comum de cidadania assente em valores e princípios essenciais ao Estado de Direito. Na urgência de maior eficácia na prevenção e repressão da criminalidade organizada, o presente trabalho visa argumentar a eficácia e eficiência das apreensões como instrumento indispensável na obtenção da prova no espaço penal europeu para a descoberta da verdade material e realização de justiça, impedindo que os criminosos tirem o máximo partido da ausência de fronteiras entre os Estados-Membros. Em contrapartida procuramos dar ênfase à necessidade de harmonização dos sistemas jurídicos dos Estados-Membros, na construção de um espaço penal não-securitário que respeite e salvaguarde os direitos fundamentais do cidadão europeu, sem distorcer o equilíbrio imposto entre a tutela de interesses e a tutela de bens jurídicos individuais e supra-individuais. | pt_PT |
| dc.description.abstract | The nature and extent of organized crime, without a defined territory and borderless, in an area of free movement of people, goods, services and capital came to demand new answers in the criminal policy of the European Union, giving primacy to judicial and police cooperation and mutual recognition in the service of freedom and security in a common space of citizenship based on shared values and principles essential to the rule of law. In the urgency of greater efficiency in the prevention and repression against organized crime, this paper aims to argue the effectiveness and efficiency of apprehensions as an essential tool in obtaining evidence in the European criminal justice area for the discovery of material truth and accomplishment of justice, preventing criminals from taking full advantage of the absence of borders between Member States. On the other hand we seek to emphasize the need for harmonization in the legal systems of the Member States, in the construction of a criminal non-securitarian justice area which respects and safeguards the fundamental rights of the European citizen, without distorting the balance between protecting the interests and the protection of individual and supra-individual legal rights. | pt_PT |
