Abstract(s)
O presente trabalho tratará de importante e delicado tema relacionado ao terrorismo
contemporâneo, também chamado de novo terrorismo, que tem se utilizado da disseminação
de ações e de ideologias extremistas, bem como da radicalização violenta por meio da internet
e das redes sociais. Partindo de inovação no campo jurídico brasileiro, através da edição da
novel lei antiterrorismo (Lei 13.260/2016) e de recente investigação operacionalizada pela
Polícia Federal do Brasil, apresentar-se-á uma pesquisa acadêmica aprofundada acerca desta
forma de atuação do terrorismo transnacional. Aproximar-se-ão os fenômenos da legislação,
doutrina e jurisprudência de âmbito nacional aos de âmbito internacional. Sob o escopo do
princípio da taxatividade e da proibição de proteção deficiente, buscar-se-á avaliar a ação
deflagrada e a legislação brasileira em relação a eventual restrição de direitos fundamentais.
The present work will deal about an important and delicate topic related to contemporary terrorism, also called new terrorism, which has been used for the dissemination of extremist actions and ideologies and violent radicalization through the internet and social networks. Starting from an innovation in the Brazilian legal field, through the edition of the novel antiterrorism law (Law 13.260/2016) and a recent investigation operationalized by the Federal Police of Brazil, a thorough academic research will be presented about this form of transnational terrorism. Will be approached the phenomenon to national and international legislation, doctrine and jurisprudence. Under the scope of the principle of taxativity and the prohibition of deficient protection, will be evaluate the action taken and the Brazilian legislation in relation to any restriction of fundamental rights.
