Abstract(s)
No âmbito, quer da comunidade internacional, quer da nacional, cada vez mais é
prestada atenção e dada grande importância, às questões da segurança marítima, onde se
encontram incorporados os aspetos relacionados com a prevenção, a resposta e a análise a
sinistros marítimos, seja pela necessidade da salvaguarda da vida humana, seja pelos custos
materiais ou pela prevenção da poluição.
A Marinha, enquanto ator com um papel preponderante nas questões marítimas e
no uso do mar, não pode deixar de dar o seu contributo para a prevenção de acidentes e
para o aumento da segurança marítima, nas mais variadas vertentes.
Já para AMN (Autoridade Marítima Nacional), esta problemática é bastante atual,
uma vez que esta entidade possui um papel crucial num leque muito vasto de
responsabilidades em âmbito marítimo, especialmente no que respeita ao exercício da
autoridade do Estado no mar.
Pretende-se assim, com esta dissertação de mestrado, analisar a forma como a
Marinha e a AMN atuam no âmbito da segurança no mar, especialmente, do seu papel em
matérias de acidentes marítimos, incluindo a sua análise.
No primeiro capítulo começa-se por analisar resumidamente a importância que o
mar apresenta para Portugal. No segundo, clarifica-se o panorama da segurança do mar,
numa perspetiva legal, aprofundando-se os seus desenvolvimentos históricos até aos dias
de hoje. Já no terceiro capítulo, é abordada a problemática dos sinistros marítimos na
índole nacional, esclarecendo-se o panorama atual desta realidade. No quarto capítulo,
aborda-se os desenvolvimentos legais de índole internacional, europeia e nacional, da
investigação técnica de acidentes e incidentes marítimos, analisando-se as diferenças entre
as investigações realizadas no âmbito da AMN, da Marinha e do GPIAM (Gabinete de
Prevenção e de Investigação de Acidentes Marítimos). No quinto, explana-se a importância
do conhecimento dos espaços marítimos nacionais e apresentam-se as incumbências
específicas dos vários organismos com responsabilidades nesta área.
Por fim, no sexto capítulo, são apresentadas as conclusões, que tentarão dar um
contributo forte e conciso, para a segurança marítima quer na Marinha, quer na AMN, e a
nível nacional e internacional.
From the point of view of both the international and national communities, more and more attention is being paid and significant importance is being given to issues of maritime safety. Questions arise regarding prevention, the response to and analysis of maritime crimes whether these be related to human safety, costs of materials or the prevention of pollution. As a main player in maritime issues as well as in the use of the sea, the Navy must contribute (in the most diverse ways) to these communal goals regarding the prevention of accidents and the increase of maritime safety. However, for the National Maritime Authority (NMA), this problem is quite current, since this entity has a crucial role in non-military missions, distinguishing itself in its role in concerns relating to maritime safety. The aim of this master’s dissertation is to analyze how the Navy and the National Maritime Authority act when it comes to safety at sea, specifically concerning their functions in maritime accidents. Therefore, the first chapter briefly analyzes the importance of the sea in Portugal. The second provides a panoramic view of the security of the sea, in a legal perspective, from its historic developments to the present. The third chapter discusses the problem of maritime accidents from a national point of view, illustrating the current panorama of this reality. Chapter four divulges international, European and national legal developments, the technical investigation of maritime accidents and incidents and the analysis of the differences between the NMA, the Navy and GPIAM investigations. The fifth chapter expounds on the importance of national maritime space, as well as the roles of the different organizations with responsibilities in this area. Finally, conclusions are presented, which, in a certain way, attempt to provide a strong and concise contribution both nationally and internationally to maritime safety issues in the Navy and in the NMA.
