A Partilha de Informação Criminal e a Cooperação

Abstract(s)
A Guarda Nacional Republicana apresenta uma estrutura hierarquizada e uma
distribuição a nível nacional, da qual é possível retirar vantagens, principalmente em matéria de investigação criminal, mas para tal, é indispensável que a partilha de informação criminal entre os órgãos que desenvolvem missões de investigação criminal ocorra de forma eficiente, isto é, que se consigam atingir os objetivos, aplicando os recursos de forma vantajosa.
Avaliar essa mesma eficiência, e saber quem, quando, como e todos os porquês
associados à partilha de informação criminal, bem como a análise dos mecanismos que são e que deveriam ser usados na partilha, são os desideratos desta investigação.
Este estudo realizado com base na análise concetual, na análise legal e no traba lho
de campo baseado em questionários realizados aos chefes dos órgãos que desenvolvem missões de investigação criminal, e na realização de entrevistas ao escalão mais estratégico, permitiram afirmar que os mecanismos utilizados não se encontram ao acesso de todos, não garantem uma partilha segura e o sistema que deveria ser o principal mecanismo de partilha (sistema integrado de informações operacionais policiais) não apresenta os resultados que deveria. Concluiu-se ainda que embora exista consciência da importância da partilha, a diferença entre a informação que se diz ser partilhada e aquela que realmente fica acessível, assume uma discrepância considerável.
Pode-se assim afirmar que não existe uma partilha de informação criminal eficiente
na Guarda Nacio nal Republicana.
Deste modo, afigura-se urgente definir uma estratégia neste sentido, para garantir que todos têm acesso ao Sistema Integrado de Informações Operacionais Policiais, propondo-se a criação de orientações onde constem clara e objetivamente todos os aspetos relativos à partilha, bem como à responsabilização daqueles que têm obrigações nesta área.
Só garantindo que todos passem a partilhar, se poderá vir a afirmar que existe cooperação pela partilha de informação criminal.
Abstract The Portuguese Gendarmerie it is organized in a hierarchical structure and it is disseminated all over the country. This national distribution has enormous advantages, mainly in criminal investigation labor. However to obtain a real advantage from it, will be necessary to share the information produced by the teams who develop criminal investigation missions. This information sharing must occur in an efficient system, in order to allow achieving the goals, always applying the resources in a proficient scheme. Evaluating that same efficiency, as well as knowing who, when and how to share that information, or even which tools must be used to provide the possibility to share, are the purposes of our research. This scientific research, accomplished through a conceptual and legal analysis and a field work, based in questionnaires, addressed to the leaders of the teams who usually developed criminal investigation tasks, and the completion of interviews, to the leaders at the strategic level, allowed us to say that the mechanisms in use are not available for everyone and also do not ensure a secure sharing. The Gendarmerie system that should be the main sharing mechanism, called “Police Operational Information Integrated System”, do not outcomes yet the results expected. We also concluded that there is a consciousness about the importance of sharing, but the lack between shared information and availability of the information needed, it is substantially huge. So we could verify that, in the Portuguese Gendarmerie, does not exist an efficient information sharing attitude. It is consequently an urgent need to define a strategy to ensure that everyone who needs has access to the “Police Operational Information Integrated System”, and we dare to propose the creation of specific guidelines where must be set, clearly and objectively, all the aspects connected with sharing, as well as the responsibility of those who have obligations in this subject. Only ensuring that everyone shares, it will be really possible to say that we have cooperation through information sharing, something that does not happens at present the moment.
