| dc.description.abstract | O presente Trabalho de Investigação Aplicada está subordinado ao seguinte tema: o uso de armas não letais na atividade operacional A atuação policial está regulada e orientada por um conjunto variadíssimo de diplomas legais internacionais e nacionais, a qual devendo restringir-se ao mínimo indispensável de forma a respeitar os direitos fundamentais dos cidadãos, como o direito à vida e à integridade física. Contudo, existem situações em que as forças de segurança se vêm obrigadas a fazer uso de meios coercivos, adequando-se aos princípios da legalidade e da mínima força. Com o desenvolvimento das tecnologias ao nível do armamento, foram criados meios concebidos para neutralizar, controlar e incapacitar temporariamente indivíduos, animais ou materiais, infligindo lesões ou danos menores. A GNR, como força de segurança, tem vindo a adquirir estes meios indispensáveis para a concretização da sua atividade operacional O ponto de partida para o início da investigação deste trabalho prendeu-se com a formulação da seguinte questão central: as Armas Não Letais são uma ferramenta válida para garantir a eficácia policial e respeitar os direitos do homem? Os objetivos definidos para este trabalho pretendem verificar as hipóteses formuladas, a partir das questões de investigação levantadas, de forma a responder à questão central. A metodologia adotada baseou-se em duas fases. Numa primeira realizou-se a revisão da literatura sobre o tema. Numa segunda fase realizaram-se entrevistas a Oficias com funções de comando, e inquéritos por questionário a Sargentos e Guardas que prestam serviço nas subunidades GIOP e GIOE. Conclui-se que as armas não letais constituem um meio importante na atuação policial, uma vez que permitem uma melhor escalada nos patamares do uso progressivo da força pelos elementos da força de segurança, infligindo o mínimo de mazelas físicas. Constituem assim uma ferramenta válida para o respeito dos direitos constitucionalmente protegidos. Contudo verificou-se que a sua distribuição generalizada pelo dispositivo territorial se apresenta escassa, derivado dos custos inerentes a estes meios. | por |
| dc.description.abstract | Abstract The theme of this Applied Investigation Project is the use of non lethal weapons in operational activities. The police work is very well regulated and oriented by a wide variety of national and international laws, and it should be the minimum in order to respect the citizen’s fundamental rights, such as the right to life and physical integrity. However, there are times when security forces must use more coercive methods, but always within the legal boundaries and with the use of minimum force. With the development of modern weapons, came the ability to temporarily neutralize, control and incapacitate individuals, animals or even vehicles causing the least damage possible. The GNR has acquired several of these new technologies to better achieve its goals as a security force. The following question was the starting point of this investigation: are non lethal weapons a valid tool to guarantee an effective police work and respect human rights? The purpose of this investigation is to verify this hypothesis using the existing questions, in order to answer the main issue. To do so, this work was divided in two phases. First there was a review of the literature related to this subject. After that, interviews were made to Officers in command and several inquiries to Sergeants and Guards on active duty in GIOP and GIOE. The conclusion of this investigation is that non lethal weapons are an important tool to the police, since it allows a progressive increase in the use of force while inducing minimal damage on people or properties. Thus, it’s a valid way to respect the citizen’s constitutional rights.
