O fator motivante do presente trabalho sobre Crimes gerados por manifestações populares: Uma análise jurídica com foco na prevenção e planejamento estratégico da Brigada Militar, deve-se ao elevado número de manifestações populares ocorridas em Porto Alegre, na área central onde se situa a sede do governo estadual, principalmente a partir do ano de 2013. Atualmente, as manifestações na Capital, são quase que diárias, chegando a um número de 233 (duzentas e trinta e três) em 2016. Tal constatação desperta a pronta resposta da Brigada Militar, responsável pela manutenção e restabelecimento da ordem pública, bem como o interesse em melhorar o seu planejamento estratégico, com foco específico na prevenção e repressão dos principais crimes ocorridos no cenário das manifestações populares.
Considerando a importância da atuação policial nestes eventos, contemplados por grande aglomeração de pessoas, e, dentre elas inseridas as ações de criminosos, que acabam prejudicando o direito de reunião pacífica, a problemática em questão visa averiguar como a polícia militar do Estado do Rio Grande do Sul previne e reprime os principais crimes constatados neste contexto. Por outro lado, de forma secundária elenca os principais crimes praticados e os procedimentos adotados pela instituição para bem cumprir sua atuação.
Para o efeito, analisou-se historicamente a evolução das manifestações no Brasil, a Legislação Federal, Estadual e Institucional, no que discorre sobre o direito de reunião e manifestação, bem como a atuação da Brigada Militar com base em normas internas. E por fim, enquadrou-se os principais crimes combinados com procedimentos cabíveis executados pela BM.
The motivating factor of the present work on Crimes generated by popular Manifestations: A legal analysis focused on the prevention and strategic planning of the Brigada Militar, is due to the high number of popular manifestations that took place in Porto Alegre, in the central area where the headquarters of the manifestations in the capital are almost daily, reaching a number of 233 (two hundred and thirty-three) in 2016. This confirms the prompt response of the Brigada Militar, responsible For the maintenance and restoration of public order, as well as the interest in improving its strategic planning, with specific focus on the prevention and repression of the main crimes occurred in the scene of popular manifestations. Considering the importance of the police action in these events, contemplated by a large agglomeration of people, and among them included the actions of criminals, which end up hampering the right of peaceful assembly, the problematic in question seeks to ascertain how the military police of the State of Rio Grande Of the South prevents and represses the main crimes found in this context. On the other hand, in a secondary way, it lists the main crimes committed and the procedures adopted by the institution in order to comply with its actions. For this purpose, the evolution of demonstrations in Brazil, the Federal, State and Institutional Legislation, has been analyzed historically, in which it discusses the right of assembly and demonstration, as well as the performance of the Brigada Militar with internal norms. Finally, the main crimes were combined with appropriate procedures carried out by the BM.
