A obtenção de prova digital pode consubstanciar, nos dias de hoje, uma excelente
forma de fazer justiça, sendo o correio electrónico a peça sine qua non seria inglório fazer
referência a estes novos métodos de investigação. Os e-mails são, assim, o caminho que as
polícias têm de desbastar para que se rompam as cortinas de alguns túmulos, ainda ocultos
ou pouco desmistificados. O regime à luz do qual se regem estas matérias, terá de coar
atentamente os valores a serem postos em causa, funcionando todo o enredo processual
num desejável equilíbrio entre os aspectos constitucionais que protegem individualmente
cada pessoa, e a própria luta contra a criminalidade.
Significa isto que a intercepção, acesso, ou apreensão de e-mails, podendo ou não
configurar um meio oculto de investigação, revela-se como sendo um potente meio de
(obtenção de) prova, importando que se esclareça um padrão de actuação, para que se
afaste o carácter vago de algumas soluções legais.
The acquisition of digital proof substantiates, in present day, an excellent form of providing justice, so long as e-mail is the tool that references these new investigative methods. E-mails are, therefore, the piece that police must unveil like the curtains covering some tombs, still hidden or barely demystified. The light regime that regulates these tools, must carefully tabulate the values being challenged, executing the procedural scenarios in a desirable balance between the constitutional aspects that individually protect each person, as well as the fight against crime. This means that the interception, access, or apprehension of e-mails, if it can be set up as a concealed means of investigation, reveals itself to be a powerful method of (obtaining) proof, providing the existence of a clear action plan, in order to set aside the obscurity of certain legal solutions.
