Abstract(s)
O presente estudo teve como propósito analisar as restrições e proibições de acesso
a estádios da 1.ª liga de futebol português à luz do respeito pelos direitos, liberdades e
garantias do cidadão e da legislação vigente, genericamente, justificadas pela
obrigatoriedade de possibilitar o usufruto de um espetáculo desportivo em segurança, ainda
que, amiudadas vezes, coartando a liberdade de o adepto desfrutar e demonstrar o seu
apoio clubístico com vestuário e adereços livremente escolhidos.
As restrições em apreço são suscetíveis de constituir uma não desejável redução da
dimensão service, que é um dos fatores que contribui para a redução de focos de tensão
geradores de comportamentos violentos no decurso de policiamentos a jogos de futebol.
Concluiu-se pela constitucionalidade das normas restritivas, desde que impostas por
fundadas razões de salvaguarda da integridade física dos espetadores; pela necessidade de
uniformização das regras de acesso aos recintos desportivos; e pela necessidade de serem
tidas em conta as especificidades de cada recinto aquando da elaboração de pareceres por
parte da PSP, salvaguardando que deve visar-se a concordância entre as normas e as
práticas, bem como a uniformização ao nível dos promotores.
The purpose of this study was to analyze the restrictions and prohibitions on access to stadiums of the portuguese 1st soccer league in the light of the respect for the rights, freedoms and guarantees of citizens and current legislation, generally justified by the obligation to enable the enjoyment of a sporting event in safety, although often limiting the freedom of the supporter to enjoy and demonstrate their club support with freely chosen clothing and props. The restrictions in question are likely to constitute an undesirable reduction of the service dimension, which is one of the factors that contributes to the reduction of hotbeds of tension that generate violent behavior during the policing of soccer games. It was concluded that the restrictive rules are constitutional, provided that they are imposed for justified reasons of safeguarding the physical integrity of spectators; that there is a need to standardize the rules of access to sports venues; and that the specificities of each venue should be taken into account when the PSP is drawing up its opinions, safeguarding that the concordance between rules and practices should be sought, as well as standardization at the promoters level.
