Abstract(s)
A contratação pública visa a satisfação de necessidades de entidades públicas, onde se
insere a Polícia de Segurança Pública. O Código de Contratos Públicos, aprovado pelo
Decreto-Lei n.º 18/2008, de 29 de janeiro, efetua a regulação da disciplina aplicável à
contratação pública e ao regime substantivo dos contratos públicos que revistam a natureza
de contrato administrativo. A introdução do gestor do contrato, no Direito Português,
ocorreu somente aquando da revisão do Código de Contratos Públicos, operada pelo
Decreto-Lei n.º 111-B/2017, de 31 de agosto, em alinhamento com o Direito Europeu da
Contratação Pública. A institucionalização desta figura, previsto no art.º 290.º-A do
Código de Contratos Públicos, constitui uma boa medida de gestão dos contratos públicos
e consequente garantia do interesse público subjacente aos contratos celebrados. O gestor
do contrato possui um conjunto de deveres e poderes fixados, no âmbito do
acompanhamento permanente da execução dos contratos, no entanto é necessário garantir
as condições necessárias para o seu pleno desempenho. Deste modo, o presente estudo visa
refletir sobre os formalismos intrínsecos à sua designação e ao exercício dos seus poderes,
por forma a aferir do seu impacto na atividade desenvolvida pelo gestor do contrato.
Public procurement aims to meet the needs of public entities, such as the Public Security Police. The Public Contracts Code, approved by the Decree-Law 18/2008 of 29 January, regulates the applicable terms for public procurement and complementary legislation related to administrative contracts. In compliance with the European Public Procurement Directives, the revision of the Public Contracts Code, implemented by the Decree-Law 111-B/2017 of 31 August, introduced the contract manager into the Portuguese legislation. This new role has provided a good measure for public procurement management, and a guarantee that contracts honour the public interest. The contract manager has a set of competencies and responsibilities within the permanent monitoring of procurement processes; however, it is necessary to ensure that the required conditions are in place for their performance. This study focuses on the legal procedures related to the contract manager’s appointment and exercise of powers in order to understand how these factors influence their activity.
