Abstract(s)
A investigação subsequente terá como finalidade o estudo da influência da implementação das câmaras de videovigilância no Santuário de Fátima, através do seu uso como um possível meio eficaz de prevenção da criminalidade, por este ser um importante centro de peregrinação para o mundo católico. Assim, mostra-se necessário a sua adequação a todos os trâmites legais, bem como a análise de todo o processo envolvente à sua instalação, desde o protocolo inicial entre a GNR e a entidade responsável pela administração do Santuário até ao último pedido de renovação, por parte do Gabinete do General Comandante Geral da GNR, como todo um conjunto de correspondência entre todas as entidades com a sua quota-parte de responsabilidade na implementação deste sistema de videovigilància, com o intuito de também verificar no espaço delimitado pelo estudo se de facto a utilização da videovigilância irá afetar alguns dos direitos fundamentais. São ainda elencados os resultados obtidos pelo tratamento dos dados estatísticos, a nível criminal, referente aos períodos que antecederam a implementação da videovigilância no Santuário, comparativamente ao espaço temporal subsequente, de modo a refletir a eventual eficácia do sistema, a nível de frequência e tipologia de crimes, bem como à possível transferência destes. Como complemento à investigação e ao trabalho desenvolvido foram realizados três entrevistas a entidades diretamente responsáveis pela temática em apreço. Interessa referir a importância da implicação do sistema para a redução do sentimento de insegurança, permitindo também o decréscimo dos índices criminais, utilizando a prevenção e repressão criminais, bem como o importante auxílio em matérias do foro de proteção civil. No entanto, a Lei nº 1/2005, de 10 de janeiro, obriga ao cumprimento de todo um conjunto de requisitos essenciais na salvaguarda dos direitos fundamentais, que no caso em estudo não estão a ser cumpridos, tornando-se imperativo a adoção de medidas necessárias para o cumprimento da Lei, por parte da administração do Santuário, estando em falta desde o término do período de vacatio legis da Portaria nº 373/2012 de 16 de outubro
This investigation aims to study the influence of the implementation of surveillance cameras in the Sanctuary of Fatima, through its use as a possible effective tools of crime prevention, because this is an important pilgrimage center for the catolic world. It appears necessary to verify its suitability for all legal purposes, as well as an analysis of the entire process surrounding the installation, from the initial protocol between the GNR and the entity responsible for administering the sanctuary to the last renewal application to the GNR Commander General. This includes a whole set os correspondence between all entities with their share of responsability in the implementation of this surveillance system, in order to also check the space delimited by the study to determine whether the use of video surveillance will affect some fundamental rights. The results obtained by the treatment of statistical data, at a criminal level are listed, for the periods prior to the implementation of video surveillance in the Sancturary, compared to subsequent time to reflect the likely effectiveness of the system, the level of frequency and typology crimes, as well as the possible transfer of these. Three interviews with entities directly responsible for the issue in question are included as a complement to this research and work. The importance of involving the public to reduce feelings of insecurity, was also noted and the decrease in crime rates, using conventional forms of crime prevention, as weel as an aid in the important matters of the court of civil protection. However, Law nº 1/2005, of 10 January, requires the completion of a whole set of requirements, essential safeguarding of fundamental rights, which in our case are not being met, making it imperative to adopt the necessary measures to comply with the law, Sanctuary management, incomplete since the adaptation of the Ordinance nº 373/2012, of 16 October.
