Abstract(s)
O Serviço Militar Obrigatório é o conceito extensivo a todos os cidadãos do sexo
masculino ou universal, para prestarem serviço, no âmbito militar, ao seu país. Conceito
que se entende como um direito e um dever de todos os cidadãos.
Durante longos e até há poucos anos atrás, o Serviço Militar Obrigatório estava em
vigor em Portugal, onde ingressavam jovens cidadãos portugueses que alimentavam as
fileiras das Forças Armadas Portuguesas.
O Regime de Contrato viria a substituir então o antigo Serviço Militar Obrigatório,
fazendo com que assim fosse apenas a única forma de Admissão e Prestação de Serviço
nas Forças Armadas.
Contudo Portugal tem bem definido quais os seus interesses na esfera internacional e
nacional no âmbito da defesa e segurança, como tal definiu a Lei da Defesa Nacional, o
Conceito Estratégico de Defesa Nacional, o Sistema de Forças e o Dispositivo Naval.
Dispositivo Naval esse, que necessita de meios humanos para desempenho das tarefas
atribuídas, ao qual a Lei do Serviço Militar vem estipular e regulamentar as formas de
admissão e prestação de serviço nas Forças Armadas.
Desta forma, a presente dissertação aborda, de forma exploratória, em que medida o
serviço de conscrição seria mais vantajoso e poderia contribuir para colmatar o défice
de meios humanos, na Marinha, na Área Operacional - Navios.
Para tal, na presente investigação foi feito um breve enquadramento histórico do SMO
relativo à sua origem e o surgimento em Portugal. Foi feita uma revisão bibliográfica
sobre a Lei de Defesa Nacional, o Conceito Estratégico de Defesa Nacional, a Lei
Orgânica da Marinha e a Lei do Serviço Militar. Por fim foram analisados dados
relativos aos conjuntos das necessidades vs. existências na área operacional – navios.
Com a análise da informação foi retirado, indutivamente, que o atual sistema de
admissão e prestação de serviços compromete as existências dos meios humanos para o
cumprimento das missões atribuídas à Marinha.
Desse modo, deixa-se neste trabalho evidência das vantagens e possíveis desvantagens
da reimplementação do SMO e propõem-se temas para continuação do estudo realizado.
The Compulsory Military Service is extended to all citizens of the male sex or universal concept, to provide service, the military, to his country. Concept that is understood as a right and a duty of all citizens. For long and until a few years ago, the obligatory military service was in force in Portugal, where young people were entering Portuguese citizens that fed the ranks in the Armed Forces. The Board of Contract would then replace the old compulsory military service, making it were just the only way to Admission and Service Delivery in the Armed Forces. However Portugal has well defined your interests in international and national level in the field of defense and security, such as defined by the National Defence Act, the Strategic Concept of National Defence, Forces System and Naval Forces device. Naval Forces device, that needs human resources to perform the tasks assigned, to which the Military Service Law comes stipulate and regulate the intake forms and provision of service in the Armed Forces. This way, this thesis discusses, in an exploratory way, to what extent the service conscription would be advantageous and could help to bridge the gap in human resources, the Navy, the Operational Area - Ships. Thus, for the present investigation was done a brief historical background of the SMO on the origin and the rise in Portugal. A literature review on the National Defence Act, the Strategic Concept of National Defence, the Organic Law of the Navy and the Military Service Law was made. Finally the analyzed data sets versus the needs stocks in the operational area - ships. With the analysis of the information was taken, inductively, that the current system of admission and services commits stocks of human resources for the accomplishment of missions assigned to the Navy. Thus, this evidence allowed to work the advantages and possible disadvantages of reimplementation of SMO or proposing topics for further study.
