| dc.description.abstract | O presente Trabalho de Investigação, com o título “O uso da prova digital na investigação do crime de Violência Doméstica” tem como principal objetivo aferir as potencialidades e as condicionantes do recurso à prova digital na investigação do crime de Violência Doméstica na ação policial da Guarda Nacional Republicana. Neste sentido, considerou-se de elevada relevância analisar os processos-crime de um determinado ano e proceder à análise comparativa entre os inquéritos com recurso a Prova Digital e sem Prova Digital, visando-se aferir a importância desse tipo de prova na investigação do crime de Violência Doméstica. Adicionalmente à análise dos processos, foram realizados também inquéritos por entrevista e por questionário, com o intuito de complementar o presente estudo com a experiência e perceções de quem trabalha diariamente nesta área. Esta abordagem materializou-se de forma qualitativa (entrevistas) e quantitativa (questionário). Recorreu-se a uma estratégia metodológica de estudo de caso, realizado no Núcleo de Investigação e Apoio a Vítimas Específicas do Comando Territorial de Leiria. Os resultados obtidos permitem concluir que o uso da Prova Digital no âmbito do crime de Violência Doméstica tem uma elevada importância, uma vez que contribui para uma maior taxa de acusação do agressor. Verificaram-se algumas tendências características dos casos em que é recolhida a Prova Digital, nomeadamente as idades mais jovens dos intervenientes do processo, bem como a relação existente entre estes ser maioritariamente entre cônjuge, ex-cônjuge ou análogo. O agressor tem um perfil mais controlador/possessivo e comete o crime muitas vezes à distância, sem se expor a si próprio. A necessidade de formação, atualização dos equipamentos técnicos e da legislação e o aumento do efetivo foram pontos salientados pelos entrevistados e pelos militares que responderam ao questionário como fundamentais para melhorar a capacidade de análise da Prova Digital, e, consequentemente, o apoio disponibilizado às vítimas. | pt_PT |
| dc.description.abstract | This research work, which title is "The use of digital evidence in the investigation of the crime of Domestic Violence" has as main objective to assess the potential and constraints of the use of digital evidence in the investigation of the crime of Domestic Violence in the police action of the National Republican Guard. In this regard, it was considered of high relevance to analyze the criminal cases of a given year and make a comparative analysis between the investigations with and without the use of Digital Evidence, in order to assess the importance of this kind of evidence in the investigation of the crime of Domestic Violence. In addition to the analysis of the cases, surveys in the form of interviews and questionnaires were also conducted, in order to complement this study with the experience and perceptions of those who work daily in this area. This approach was materialized in a qualitative (interviews) and quantitative (questionnaires) manner. A case study reseach was carried out at the Center for Investigation and Support to Specific Victims of the Territorial Command of Leiria. The results obtained allow us to conclude that the use of Digital Evidence in the scope of the crime of Domestic Violence is of high importance, since it contributes to a higher rate of indictment of the aggressor. Some tendencies amongst the cases in which Digital Evidence is collected were verified, namely the younger ages of the participants in the process, as well as the fact that the relationship between them is mostly between spouses, ex-spouses or similar. The aggressor has a more controlling/possessive profile and often commits the crime at a distance, without exposing themself. The need for training, updating of the technical equipment and legislation, and increasing the number of personnel were some of the points highlighted by the interviewees and the military who answered the questionnaire survey as fundamental requirements to improve the ability to analyze Digital Evidence and, consequently, better support the victims. | pt_PT |
