Este trabalho de investigação subordinado ao tema "Políticas de Combate ao Terrorismo:
Segurança Colectiva Vs Direitos Individuais – O Panorama Português" tem como objectivos
principais: identificar a necessidade de uma definição global de terrorismo; enunciar uma
possível definição de terrorismo; encontrar as medidas que Portugal deve adoptar para a
prevenção e combate do terrorismo; demonstrar a necessidade do emprego das Forças Armadas no combate ao terrorismo sendo ele uma ameaça de índole interna ou externa e que afecta a integridade física do território nacional e verificar se Portugal está preparado para combater o terrorismo.
Para se conseguir determinar esses objectivos foi empregue o método qualitativo, por intermédio de entrevistas e pesquisa documental queseguiram um tratamento através da técnica de análise do conteúdo horizontal. Após o tratamento conclui-se que arranjar uma definição global de terrorismo é uma tarefa urgenteno seio da comunidade internacional, no entanto difícil e isto devido à complexidade do fenómeno.
Da análise das diversas definições, resulta a existência de um denominador comum que possibilitou a elaboração de uma definição operativa.
Apesar de Portugal não ser um alvo prioritário dos terroristas é fundamental que tome precauções para que não seja surpreendido. Não existem soluções milagrosas na prevenção e combate do terrorismo, ainda assim adquirir uma maior coordenação de todos os organismos envolvidos no plano das informações, da investigação e da segurança quer do nosso país, quer da União Europeia e ainda a nível internacional, bem como mobilizar para o combate efectivo todos os meios possíveis, são algumas medidas a ser implementadas. E como todos os meios nunca são demais na luta contra o terrorismo, é de extrema necessidade que se reveja todo o enquadramento legal do emprego das Forças Armadas no combate ao terrorismo no território nacional, pois apesar deste estar previsto existem ainda muitas lacunas que têm de ser colmatadas.
Abstract The present study subject to the theme “terrorism combat policies – collective security vs individual rights – Portuguese situation” aims as follows: to identify the need of a global definition of terrorism; to propose one possible definition of terrorism; to identify which measures should be implemented by Portugal with a view to prevent and fight terrorism; to show that the Armed Forces are necessary to fight terrorism be it either a foreign or domestic threat affecting the integrity of the national territory and to confirm whether Portugal is prepared to fight terrorism. In order to achieve those goals the method used wasqualitatively, through interviews and documentary research that followed a treatment, both treated through the method of analysis of the horizontal contents, which led to the conclusion that it is urgent that the international community defines terrorism in a global way; however even though needed as it may be, such definition is difficult due to the complexity of the terrorist phenomenon. From the analysis of the different definitions emerged one common feature that allowed for an operative definition to be established. Even though Portugal is not prioritarily targeted by terrorists, it is crucial that due cautions are taken in order to avoid surprises. There are no miracle solutions in what concerns terrorism prevention and terrorism combat; nonetheless some of the measures that can be implemented involve a larger coordination of all the intelligence, research and security agencies, either domestic or foreign, including European Union and international agencies, as well as the deployment of all means possible foreffective action. And as means are never too many insofar as terrorism is concerned, it is of the utmost importance that all legal regulation pertaining to the use of the Armed Forces in the fight against terrorism is altered, as even though said use is regulated, many loopholes remain yet to deal with.
