Abstract(s)
A presente pesquisa pretendeu analisar o papel da polícia na atualidade, a história das polícias militares, uso dos meios coercivos, o contexto da discussão sobre desmilitarização, apontando fatores contra e a favor, e como ela poderia influenciar na diminuição das ações abusivas perpetradas por policiais militares. Também foram verificadas possíveis medidas para a diminuição do uso abusivo da força, desde a formação do profissional, passando pelos fatores estressores até as formas de controle correcional de suas ações. Verificou-se que a sociedade brasileira é culturalmente violenta, e que o número de homicídios é maior que países em guerra. A polícia militar está na linha de frente da segurança pública brasileira, e por esta razão, perante o quadro de hipercriminalidade, os confrontos armados são inevitáveis, restando altos índices de óbitos. Todavia, as estatísticas utilizadas na maioria das pesquisas não condizem com o sistema constitucional e infraconstitucional vigentes, pois é necessária uma sentença penal condenatória transitada em julgado para estabelecer se a morte resultante do confronto foi dolosa, culposa ou escudada em uma excludente de ilicitude. O trabalho consistiu em uma ampla revisão bibliográfica, buscando trazer com imparcialidade argumentos contra e a favor da desmilitarização, assim como todos os fatores dela decorrentes.
The present research aimed at analyzing the role of the police at present, the history of the military police, the use of coercive means, the context of the discussion about demilitarization, pointing out factors against and for, and how it could influence the reduction of abusive actions perpetrated by police officers military. We also verified possible measures to reduce the abusive use of force, from the formation of the professional, through the stressors to the forms of corrective control of their actions. It has been found that Brazilian society is culturally violent, and that the number of homicides is higher than countries at war. Military police are at the forefront of Brazilian public security, and for this reason, in the face of hyper-crime, armed confrontations are inevitable, leaving behind high death rates. However, the statistics used in most of the surveys do not correspond to the constitutional and infraconstitutional system in force, since a convicted criminal conviction is necessary to establish whether the death resulting from the confrontation was intentional, guilty or escuded in an exclusion of unlawfulness. The work consisted of a broad bibliographical review, seeking to bring with fairness arguments against and in favor of demilitarization, as well as all the factors arising from it.
