Afetação de recursos da Polícia de Segurança Pública nos espetáculos desportivos de risco elevado: uma avaliação económica

| dc.description.abstract | No plano económico e social incumbe prioritariamente ao Estado promover a justiça social e o aumento do bem-estar social e económico e da qualidade de vida das pessoas. É também tarefa fundamental do Estado garantir o exercício do direito à segurança, cabendo à Polícia assegurar esse exercício. Enquanto bem económico, a segurança parece identificar-se como um bem público puro, porém, em certas situações, verifica-se que existe uma clara individualização do benefício colhido com a prestação do serviço de segurança, entendendo-se ser o caso dos promotores de espetáculos desportivos de natureza nacional, considerados de risco elevado. Com efeito, de acordo com o Decreto-Lei n.º 216/2012, de 09 de outubro, alterado pelo Decreto-Lei n.º 52/2013, de 17 de abril, a responsabilidade pelos encargos com o policiamento de espetáculos desportivos é suportada pelos respetivos promotores, no entanto, cabe ao Estado assegurar o policiamento nas áreas exteriores ao recinto desportivo, através da Polícia. Com o presente trabalho de investigação pretendeu-se efetuar uma avaliação económica da afetação de recursos da Polícia de Segurança Pública (PSP) nas operações de segurança a espetáculos desportivos de natureza nacional, considerados de risco elevado. Foi selecionado como caso de estudo a operação de segurança ao jogo de futebol ocorrido no dia 14 de dezembro de 2014, na cidade do Porto, entre o Futebol Clube do Porto e o Sport Lisboa e Benfica. Aos dados obtidos sobre a afetação de recursos da PSP à operação de segurança em apreço, foi aplicado o método quantitativo e técnicas de contabilidade consideradas adequadas à determinação dos custos resultantes da afetação de recursos da PSP. Verificou-se que os custos relativos à afetação de efetivo policial à operação de segurança ao evento em estudo, em serviço público, foram superiores aos iii suportados pelo promotor com o efetivo policial nomeado em serviço remunerado, correspondendo, respetivamente, a 56% e a 44%. Considerando o custo total, incluindo os custos resultantes da afetação de outros recursos da PSP à operação de segurança, constatou-se que o Estado suportou o maior peso de custos, numa proporção de 50,9%, para 40,50% dos encargos assumidos pelo promotor do evento. Face aos resultados obtidos, entende-se que uma tributação mais criteriosa dos recursos utilizados pela PSP pode ser uma solução tendente a melhorar a eficiência da PSP, indo ao encontro dos princípios de justiça e de equidade orçamentais. Considerou-se ainda que para além de uma tributação mais criteriosa dos recursos utilizados pela PSP, deve ser ponderada uma alteração do rácio polícia/espetadores, no sentido de recair sobre o promotor do evento a responsabilidade pelos encargos de um maior número de efetivo policial envolvido na operação de segurança, deixando o Estado de ser o único responsável pelos encargos decorrentes do policiamento nas áreas exteriores ao recinto desportivo | pt_PT |
| dc.description.abstract | What concerns the social and the economical plan, it is the Government's duty to prioritarily promote social justice and improve the social and economical wellbeing, as well as people's quality of living. The Government must also assure the right to security, being this the Police task. As an economical issue, security seems to identify itself as a pure public issue. However, in certain situations there is a pure individualization of the benefit taken from the security service, being the national sports shows an example of this, which are considered of high-level risk. According to the Law number 216/2012 (DL nº 216/2012), from 9th of October, revised by the Law number 52/2013 (DL nº 52/2013), from 17th of April, the responsibility for the assignments concerning the policing in these shows is financially supported by the ones who promote these shows. Yet, it is the Government's duty to assure the policing in the surroundings of the sporting area, through the National Police Force (PSP) With this research, we intend to do an economical evaluation of the National Police Force (PSP) resources in the security operations towards these sports shows, which are considered to be of high-level risk. The security's operation towards the football game between Futebol Clube do Porto and Sport Lisboa e Benfica, on the 14th of December of 2014, which took place in Oporto, was chosen as a case study. We applied the quantitative method and the accounting technics considered adequated to the data we obtained about the resources of the National Security Police (PSP) involved in this specific operation. We checked that the costs related to the involvement of the police elements in this specific operation, being public service, were higher that those supported by the promotor with the police elements nominated for the extra rewarding, being respectively 56% and 44%. Considering the entire cost, including those which result from the involvement of other resources of the National Police Force (PSP), the Government payed for the highest amount, with 50.9%, while the promotor supported only 40.5% of the entire cost. Facing the results obtained, we think that a more careful taxation of the National Police Force (PSP) resources could be a solution in order to improve the efficiency of the National Police Force (PSP), leading to justice and equity concerning budget. Aside a more careful taxation of the resources used by the National Police Force (PSP), there should be a change in what concerns the ratio of the police elements to the spectators, in order to be charged to the event's promotor the responsibility for the assignments of a higher number of Police elements involved in the operaton, leaving out the Government as the only part responsible for the assignments of the policing in the surroundings of a sporting area. | pt_PT |
