Abstract(s)
As novas tecnologias proporcionaram uma mudança radical, no que diz respeito à
operacionalidade dos agentes das forças e serviços de segurança. Nos Estados Unidos da
América, tecnologias como as Body Worn Camera e as In-Car Camera Systems entraram na
rotina da polícia e auxiliam os agentes no seu trabalho / missão. São várias as vantagens que
este tipo de ferramenta tecnológica pode impactar, tanto positivamente, como também,
alguns aspetos negativos da sua utilização, impacto no comportamento dos próprios agente,
que usufruem destes dispositivos e também no comportamento dos cidadãos. Em Portugal,
ainda não está prevista a implementação e utilização das In-Car Camera Systems, no entanto,
através do estudo da Lei n.º 95/2021, de 29 de dezembro e do Decreto-Lei n.º 2/2023, de 2
de janeiro, juntamente com a demais legislação estrangeira (lei ENF-010, de 19 julho de
2023; Manual da Metropolitan Nashville Police Department de 2023 e lei 1140.11 – “Mobile
Video Recording Systems” de 14 de fevereiro de 2024), será analisada a possibilidade de
inserir as In-Car Camera Systems no mesmo diploma que as CPUI, à semelhança do que
acontece nos EUA. Será ainda abordado qual o impacto que as In-Car Camera Systems terão
nos direitos fundamentais do cidadão.
New technologies have brought about a radical change in the way security forces and services operate. In the United States, technologies such as Body Worn Cameras and In-Car Camera Systems have entered the police routine and help officers in their work/mission. There are several advantages that this type of technological tool can have, both positively and in terms of the negative aspects of its use, impacting on the behaviour of the officers themselves who use these devices and also on the behaviour of citizens. In Portugal, the implementation and use of In-Car Camera Systems is not yet planned, however, through the study of Law no. 95/2021, of 29 December and Decree-Law no. 2/2023, of 2 January, together with other foreign legislation (law ENF-010, of 19 July 2023; Metropolitan Nashville Police Department Manual of 2023 and law 1140. 11 - ‘Mobile Video Recording Systems’ of 14 February 2024), the possibility of including In-Car Camera Systems in the same legislation as CPUI will be analysed, as is the case in the USA. The impact that In-Car Camera Systems will have on citizens' fundamental rights will also be analysed.
