Abstract(s)
A sinistralidade rodoviária é uma calamidade social que afeta perentoriamente o
desenvolvimento de um país, redundando, em média, na perda de 3.000 vidas por
dia em todo o mundo, o que perfaz cerca de 1,2 milhões de mortos e 50 milhões de
feridos por ano.
Encontra-se atualmente provado que o aumento das sanções, per se, na maioria dos
casos, não é eficaz na diminuição dos acidentes rodoviários e nos seus efeitos, em
termos de mortos e feridos, não sendo a sanção prevista na lei que constitui, por si
própria, o incentivo que influi sobre o comportamento dos condutores e de outros
utilizadores das rodovias, mas sim, a sanção expetável, que é o produto da sanção
prevista nas normas legais, pela probabilidade de aplicação da lei, que inclui a
atuação dos agentes policiais.
Perante esta constatação, torna-se facilmente percetível a relevância das operações
de fiscalização rodoviária e das ações de visibilidade policial na satisfação dos
predicados de segurança rodoviária, constituindo a localização das mesmas um fator
determinante, sendo que, numa perspetiva racional dedutiva, confinada pela gestão
de recursos que são, obviamente, limitados, caberá à entidade fiscalizadora delimitar
os locais onde seja possível otimizar o seu esforço e produzir melhores resultados,
numa lógica de eficácia e eficiência que, hodiernamente pulula em todas as
atividades.
Em termos estritamente lógicos, considerando a ampla dimensão dos locais
passíveis de intervenção, parece-nos incontestável que o esforço deverá ser
direcionado para o problema, e, neste caso em concreto, o problema é o acidente, o
que resulta na relevância, entre outras, da sua localização geográfica precisa,
preferencialmente georreferenciada, evidenciando-se que, para a preparação e
prossecução da intervenção policial será indispensável a definição concreta da
localização, otimizando as atividades preparatórias e consagrando as
imprescindíveis condições de segurança para intervir.
The road traffic accidents are a social disaster that affects peremptorily the development of a country, resulting on average losses of 3,000 lives per day worldwide, which amounts to about 1.2 million deaths and 50 million injuries by year. It is currently recognized that the increase of sanctions, per se, in most cases, is not successful in the reduction of road accidents and their effects in terms of deaths and injuries, and that the penalty provided by the law itself is not sufficiently encouraging to influence the behaviour of drivers and other users of the roads, but instead the expected sanction, which is the product of the penalty provided in the legal regulations and the probability of law enforcement, including the enforcement police activities. Against this backdrop, it is easily noticeable the importance of road enforcement police operations and police visibility in the satisfaction of road safety predicates, being the location itself a determining factor, and, in a deductive rational perspective, confined by management features that are obviously limited, it is quite relevant that Police may delimit the places where it is possible to optimize their effort and produce better results, in a logic of effectiveness and efficiency that flourishes in all activities. In strictly logical terms, given the wide range of sites subject to intervention, it seems indisputable that the effort should be directed to the problem, and in this particular case, the problem is the accident, which results in relevance, among other, of the precise geographical location, preferably georeferenced. Therefor it’s demonstrated that for the preparation and prosecution of police intervention, the precise definition of the location is essential, optimizing the preparatory activities and consecrating the essential security conditions to intervene.
