A proteção de dados pessoais dos cidadãos tem sido, especialmente desde a década de
1990, uma preocupação permanente de todos os Estados Democráticos, onde se inclui
Portugal. A Polícia de Segurança Pública, no cumprimento da Lei, tem tido uma atenção
especial em matéria de proteção dos dados dos polícias e do pessoal com funções não
policiais, salvaguardando os Direitos Fundamentais que estão consagrados na Constituição
da República Portuguesa, sendo que esses dados também estão salvaguardados no âmbito
da Lei de Proteção de Dados Pessoais. Contudo, entende-se que a Polícia poderá fazer mais
quanto à defesa destes direitos dos polícias, importando, pois, acautelar que, aquando de
concursos para promoção ou publicações em ordens de serviço, não sejam divulgados, sem
necessidade, dados pessoais dos visados. Neste âmbito, importa melhorar os
procedimentos internos, por forma a evitar dessa forma que vida privada dos polícias seja
exposta e do conhecimento de terceiros. Assim, foram tratados neste estudo teórico a
forma como são divulgados dados pessoais dos colaboradores da Polícia de Segurança
Pública nos processos internos e nas publicações em ordem de serviço.
The protection of citizens' personal data has been, especially since the 1990's, a permanent concern of all Democratic States, where Portugal is included. The Public Security Police, in compliance with the Law, has been paying special attention to the protection of data of police officers and staff with non-police functions, safeguarding the Fundamental Rights that are enshrined in the Constitution of the Portuguese Republic, and those data are also safeguarded under the Personal Data Protection Act. However, it is understood that the Police can do more to defend these rights of police officers, and it is therefore important to ensure that, during contests for promotion or publications in service orders, personal data of those concerned are not unnecessarily disclosed. Within this scope, it is important to improve the internal procedures, in order to avoid that the private life of policemen is exposed and known by third parties. Thus, in this theoretical study, the way in which personal data of the Public Security Police employees are disclosed in the internal processes and in the publications in the service order were dealt with.
