Abstract(s)
O terrorismo transnacional, designadamente de fonte islâmica radical, tornou-se numa das
principais ameaças às sociedades do mundo actual. As suas especiais características e o tipo
de violência gerada aquando dos seus ataques, cujo principal objectivo é o de provocar a
morte do maior número de inocentes, tornam-no altamente reprovável. Tratando-se de um
fenómeno que interessa acima de tudo ser prevenido, sendo fundamental para essa
prevenção uma boa partilha de informações a nível internacional, pretende-se com este
estudo demonstrar em que medida a Europol, enquanto agência facilitadora da partilha de
informações no âmbito da União Europeia, se consubstancia numa estrutura cooperativa
eficaz nessa mesma prevenção. Conclui-se que a agência europeia apesar de ser uma
estrutura cooperativa e facilitadora da partilha de informações, não é tão eficaz quanto o
pretendido, devido a uma série de dificuldades e obstáculos limitadores dessa mesma
partilha. O trabalho está estruturado em três capítulos principais: o primeiro, de natureza
teórico-conceptual, incide sobre o terrorismo e o papel da partilha de informações na
prevenção do mesmo; o segundo capítulo enquadra a cooperação policial na evolução geral
da luta da União Europeia contra o terrorismo transnacional; o terceiro capítulo aborda o
tema central da partilha de informações no âmbito da Europol, clarificando o respectivo
quadro legal, orgânico e operacional, e concluindo com uma avaliação do contributo desta
estrutura cooperativa europeia para a prevenção da ameaça
The transnational terrorism, particularly from radical Islamic source, has become one of the main threats to societies in the today's world. Its special characteristics and the type of violence generated during the attacks, which main goal is to provoke the death of innocent people, make it highly reprehensible. Considering that it is a phenomenon that must be prevented, and that intelligence sharing at international level it is fundamental in that regard, this study intends to demonstrate in which way Europol, as an European agency that facilitates intelligence sharing, is an effective cooperative structure in the prevention of terrorism. We conclude that, in spite of being a cooperative and facilitator of intelligence sharing, Europol is not as effective as expected due to several difficulties and obstacles that restrict its action. This study is organized in three main chapters: the first, more theoretical and conceptual, is devoted to the terrorism and the role of intelligence sharing in its prevention; the second contextualize the police cooperation in the general evolution of the EU’s fight against transnational terrorism; the third analyses the central topic of intelligence sharing by Europol, its legal, institutional and operative framework, concluding with the assessment of its action.
