Competências da Guarda Nacional Republicana e da Polícia Marítima no Quadro de Atribuições do Sistema de Autoridade Marítima: Redundância ou Complementaridade

| dc.description.abstract | Este trabalho de investigação individual insere-se no Curso de Estado-Maior Conjunto 2016/17 e visa estudar as redundâncias e complementaridades resultantes das competências da Guarda Nacional Republicana e da Polícia Marítima, procurando contribuir para a otimização da atuação policial no quadro de atribuições do Sistema de Autoridade Marítima. Com recurso a uma estratégia de investigação qualitativa, de natureza empírica, delimitámos o nosso estudo às sobreposições, funcionais e territoriais, resultantes das competências específicas e missões de polícia das forças em análise, conjugado com as capacidades que dispõem para exercer as suas atribuições legais. Sendo o foco desta investigação duas forças de polícia, fomos inevitavelmente conduzidos para o Sistema de Segurança Interna, considerando a integração funcional e as missões desenvolvidas por ambas as instituições no âmbito deste sistema. Em suma, de forma conclusa, constatámos a existência de diversas sobreposições funcionais e territoriais, num contexto institucional juridicamente fragilizado, com aparentes prejuízos para o Sistema de Autoridade Marítima e consequentemente para o Sistema de Segurança Interna. Nesse sentido, concluímos pela unificação da Polícia Marítima e da Guarda Nacional Republicana, com ganhos resultantes da eliminação das redundâncias e da articulação das complementaridades identificadas. Abstract: This individual research work is part of the Joint Staff Course 2016/17 and aims to study the redundancies and complementarities resulting from the competencies of the Republican National Guard and the Maritime Police, in order to optimize the police action within the scope of the Maritime Authority System. Using a qualitative, empirical research strategy, we delimit our study to the functional and territorial overlaps resulting from the specific competencies and police missions of the forces under analysis, combined with the capacities they have to carry out their legal duties. Being the focus of this investigation two police forces, we were inevitably led to the Internal Security System, considering the functional integration and missions developed by both institutions under this system. In conclusion, we have verified the existence of several functional and territorial overlaps, in a legally fragile institutional context, with apparent damages to the Maritime Authority System and consequently to the Internal Security System. In this sense, we conclude by unifying the Maritime Police and the National Republican Guard, with gains resulting from the elimination of overlaps and the articulation of the identified complementarities. | pt_PT |
