A segurança das testemunhas é um pilar essencial da justiça penal num Estado de Direito Democrático e da confiança nas instituições. Este estudo procurou responder à questão: como se produz a segurança das testemunhas no âmbito da atividade policial? Desenvolvido segundo uma abordagem teórico-reflexiva, alicerçado numa metodologia qualitativa, centrou-se na atuação da Polícia de Segurança Pública (PSP), em particular do Corpo de Segurança Pessoal, responsável pela execução da proteção policial de testemunhas.
A investigação demonstrou que, embora o enquadramento legal português esteja alinhado com recomendações internacionais, persistem lacunas conceptuais e procedimentais que condicionam a eficácia das medidas de segurança. A coordenação entre a PSP, a Autoridade Judiciária e a Comissão de Programas Especiais de Segurança é determinante para uma avaliação célere do risco e para a adoção de medidas proporcionais.
O estudo reforça a necessidade de um núcleo central de análise técnica multidisciplinar, que garanta coerência e eficiência na resposta institucional. Em síntese, a eficácia da proteção depende do esforço concertado dos intervenientes, do respeito pelos direitos fundamentais da testemunha, assegurando uma estratégia integrada, especializada e proporcional.
Witness security is an essential element of criminal justice in a democratic state governed by the rule of law and of public trust in institutions. This study aimed to answer the question: How is witness security ensured within police activity? Based on a theoretical and reflective approach and using a qualitative methodology, the research focused on the role of the Public Security Police (PSP), in particular the Close Protectio Unit, which is responsible for carrying out police protection of witnesses. The findings show that, although the Portuguese legal framework is in line with international recommendations, there are still conceptual and procedural gaps that affect the effectiveness of security measures. Coordination between the PSP, the Judicial Authority and the Special Security Programmes Commission is crucial for a quick risk assessment and for the adoption of appropriate protective measures. The study highlights the need to create a central multidisciplinary technical unit to ensure consistency and efficiency in the institutional response. In short, the effectiveness of witness protection depends on coordinated action among the parties involved and on respect for the fundamental rights of the witness, ensuring an integrated, specialized and proportionate strategy.
