Crimes de Guerra em Operações de apoio à paz e o trabalho do Oficial de Infantaria na sua prevenção

| dc.description.abstract | Através de um contexto de Conflitos Armados Contemporâneos, surgem as Operações de Resposta a Crises, nomeadamente, as Operações de Apoio à Paz, sob as quais incide o Direito Internacional Humanitário como regulador da conduta das operações militares, assim surge a temática desta investigação, a ocorrência de violações ao Direito Internacional Humanitário em Operações de Apoio à Paz. Esta investigação aborda o estudo do enquadramento jurídico dos militares presentes em tal cenário, que devem reger a sua conduta em conformidade com os princípios do Direito Internacional Humanitário, destacando-se a responsabilidade dos comandantes perante os seus subordinados. O método utilizado neste trabalho foi a análise documental, utilizando em especial as leis estruturantes do Direito aplicável às Operações de Apoio à Paz. Na realização deste trabalho surgiu a necessidade de caracterizar o Direito Internacional Humanitário e os seus princípios, assim como abordar o Estatuto do Tribunal Penal Internacional, as correspondentes implicações na legislação portuguesa, e identificar as Operações de Apoio à Paz com especial enfoco nas Operações de Manutenção de Paz e Operações de Imposição de Paz, e no respetivo enquadramento jurídico. Analisando os dados obtidos, verifica-se que os militares em Operações de Apoio à Paz estão sujeitos a uma responsabilidade criminal individual, ou de chefes-militares, e as violações ao Direito Internacional Humanitário podem ser julgadas pelos sistemas jurídicos nacionais, locais, ou pelo Tribunal Penal Internacional, contudo existem atenuantes resultantes de ordens superiores dependendo do conhecimento do militar infrator, um dos casos é o militar possuir conhecimento da ilegalidade dos seus atos apesar de ordenados por superior hierárquico. | por |
| dc.description.abstract | Abstract Crises Response Operations emerge from of the context of Contemporary Armed Conflicts, namely the Peace Support Operations that concerns about the International Humanitarian Law as a regulator of the conduct of military operations, and thus arises the subject of this investigation, the occurrence of violations of International Humanitarian Law in Peace Support Operations. Therefore this research consists of the interpretation of the legal framework of the military that participate in such scenario, which should rule their conduct in accordance with the principles of International Humanitarian Law, this originated the fact of the awareness of the officers. The method used in this work was the document analysis, using in particular the structuring laws that can be applied to Peace Support Operations. In this work it became necessary to feature the International Humanitarian Law and its principles, as well as accost the International Criminal Court and its links with Portuguese law, and identify the Peace Support Operations with particular focus exclusively on Peace Keeping Operations and Peace Enforcement, and the legal framework. Analyzing the obtained data, it appears that the military in Peace Support Operations are subject to individual criminal responsibility, or heads-military, and violations of International Humanitarian Law can be judged by the national legal systems, local, or at International Criminal Court, but there are mitigating circumstances resulting from higher orders depending on the knowledge of the soldier infraction, one of the cases is the soldier have the knowledge of the illegality of their acts despite being ordered by a officer of higher rank. | por |
