No final do século XX, o crescimento acentuado do tráfego aéreo impulsionou uma
série de medidas estruturais, na União Europeia, designadas genericamente por Céu
Único Europeu que assenta, entre outros, na gestão do espaço aéreo, nomeadamente
através do conceito do Uso Flexível do Espaço Aéreo que prevê a nomeação por cada
Estado, de um High Level Airspace Policy Body (HLAPB). Em Portugal, essa entidade foi
inicialmente composta pelo Instituto Nacional da Aviação Civil, pela Força Aérea e pela
NAV Portugal E.P., designada por INFANAV, a qual foi criada através de um protocolo
celebrado entre estas entidades. No presente trabalho, demonstra-se que tal
documento é insuficiente para enquadrar em termos políticos o HLAPB. Mostra-se, assim, necessária a existência de uma política nacional de gestão de
espaço aéreo que contemple, entre outros elementos, a forma como é definido e
estruturado o HLAPB em Portugal. Através deste trabalho, procurámos: (a) identificar
perspetivas de autoridades e prestadores de serviços de navegação aérea sobre a atual
estrutura de gestão do espaço aéreo nacional e sua adequação aos requisitos da
regulamentação europeia, e (b) analisar as opiniões emitidas tendo por referência a
situação em outros países europeus.
Para concretizarmos os objetivos propostos, desenhámos um estudo qualitativo
com recolha de dados através de entrevista semi-diretiva a um conjunto de oito
participantes, selecionados por conveniência. Os dados foram sujeitos a análise de
conteúdo e os resultados permitiram elencar um conjunto de elementos para a definição de uma política de gestão do espaço aéreo nacional em Portugal, onde se
inclui, entre outros, a criação de um edifício legislativo, o envolvimento de
representantes dos principais ministérios envolvidos nesta temática e uma maior
autonomia dos órgãos de decisão estratégica, quer através de pessoas dedicadas a essa
função, como através de financiamento próprio.
At end of the 20th century, the sharp growth in air traffic boosted a series of structural measures in the European Union, generically known as the Single European Sky, which is based on airspace management, namely through the Flexible Use of Airspace concept that defines the appointment by each State of a High Level Airspace Policy Body (HLAPB). In Portugal, this entity was initially composed by the National Institute of Civil Aviation, by the Air Force and by NAV Portugal E.P., called INFANAV, which was created through a protocol signed between these entities. In this study, we assumed that such a document is insufficient to politically frame the HLAPB. It is therefore necessary to have a national airspace management policy that includes, among other elements, the HLAPB framework for Portugal. Through this study, we sought to: (a) identify the perspectives of authorities and air navigation service providers on the current national airspace management structure and its adequacy to the requirements of European regulations, and (b) analyse the opinions issued with reference to the situation in other European countries. To achieve the proposed objectives, we designed a qualitative study with data collection through a semi-directive interview with a group of eight participants, selected by convenience. The data was subject to content analysis and the results made it possible to list a set of elements for the definition of a national airspace management policy in Portugal, which includes, among others, the creation of a legislative building, the involvement of a representatives of the main ministries involved in this matter and greater autonomy of the strategic decision-making bodies, through persons dedicated to this function, and through own funding
