Abstract(s)
Este estudo trata do crime de subtração de menor, em especial quando praticado por um dos progenitores. Partindo da legislação portuguesa, particularmente a penal, analisa-se este crime e a evolução da sua penalização. Para além da legislação nacional, é analisada a jurisprudência portuguesa no que respeita à condenação pela prática deste crime. Integrando Portugal a União Europeia e encontrando-se, portanto, sujeito a normativos europeus, considerámos imprescindível a análise no que respeita a este crime da legislação comunitária, bem como a jurisprudência do Tribunal Europeu dos Direitos do Homem. Por último, apresentamos dados estatísticos que refletem a evolução da prática do crime analisado bem como duas entrevistas a profissionais judiciais, de forma a refletir o impacto deste crime para os que trabalham com a lei.
This research deals with the crime of minor abduction. Discussing the Portuguese law, especially criminal law, this crime and the evolution of its penalties are analyzed. In addition to the national legislation, Portuguese jurisprudence is interpreted concerning its conviction. As Portugal is part of European Union and, therefore, subject to European standards, we considered indispensable the study of this crime under community law and the European Court of Human Rights jurisprudence. At last, we present statistical data that reflect this crime evolution, as well as two interviews with legal professionals, to show its impact on those who work with law.
