O atual normativo de identificação judiciária lofoscópica e fotográfica – A Lei n.º 67/2017, de 9 de agosto

dc.description.abstractA Lei de Identificação Judiciária Lofoscópica e Fotográfica constitui-se como o objeto de estudo da presente investigação, tendo-se como objetivo geral avaliar o seu impacto nos direitos, liberdades e garantias dos cidadãos e na prossecução dos fins da investigação criminal. Para alcançar tal desiderato, recorreu-se ao método dedutivo, numa estratégia de investigação qualitativa sustentada na análise documental e na realização de entrevistas semiestruturadas a especialistas do Ministério Público e do Órgãos de Polícia Criminal, detentores de um vasto conhecimento técnico no domínio da ação penal e da investigação criminal. Como principais conclusões, verificou-se que a Lei de Identificação Judiciária Lofoscópica e Fotográfica veio acrescentar valor aos direitos, liberdades e garantias dos cidadãos, observando-se que na prossecução dos fins da investigação criminal existe um forte condicionalismo, especialmente, na limitação da identificação dos autores dos crimes. Como resultados da investigação, realça-se o decréscimo de recolhas de amostras referência, após a entrada em vigor da Lei, com um possível impacto na alimentação do Ficheiro Central de Dados Lofoscópicos, a médio e longo prazo, e, consequentemente, na identificação judiciária, pelo que, identificou-se a necessidade de revisão da Lei de Identificação Judiciária Lofoscópica e Fotográfica, a fim de promover o aumento da recolha dessas amostras. Abstract: The Photographic and Lofoscopic Judiciary Identification Law is the object of study of this research, having as general objective to assess its impact on the rights, freedoms and guarantees of citizens and in the pursuit of the purposes of criminal investigation. In order to achieve this goal, the deductive method was used, in a qualitative research strategy based on documental analysis and semi-structured interviews with experts from the Public Prosecutor's Office and the Criminal Police Bodies, who have a vast technical knowledge in the field of criminal prosecution and criminal investigation. As main conclusions, it was verified that the Photographic and Lofoscopic Judiciary Identification Law has added value to the rights, freedoms and guarantees of the citizens, observing that in the pursuit of the purposes of the criminal investigation there is a strong constraint, especially in the limitation of the identification of the authors of the crimes. As results of the research, the decrease in the collection of reference samples, after the entry in force of the Law, with a possible impact in the feeding of the , Lofoscopic Data Central File, in the medium and long term, and consequently in the judiciary identification, is emphasized. Therefore, the need to revise the Photographic and Lofoscopic Judiciary Identification Law was identified, in order to promote the increase of these samples.pt_PT
