No âmbito de investigações criminais de criminalidade grave os OPC têm, não raras vezes, conhecimento direto e assistem à prática de crimes menores decidindo, de forma consciente não intervir, com a assunção dos riscos e perigos dai advenientes.
Esta decisão tem que se sustentar, por um lado, no grau de demonstração da prova já existente na investigação, i.e., existência de indícios fortes ou suficientes e, por outro na previsibilidade de ocorrência dos factos e avaliação das consequências dos mesmos através da ponderação de cenários. Verificámos que, apesar de, na maioria dos casos, as omissões de ação serem legalmente admissíveis poderão não ser necessárias em termos de produção de prova – tornando-se ilegítimas e inadequadas.
Concluiu-se assim que fatores operacionais e de cultura organizacional, influenciam mais do que deveriam o processo de decisão de um dos grandes desafios atuais da investigação criminal: produção de prova vs e prevenção do dano social e legalidade.
While conducting criminal investigations on seriuous crime, police investigators, sometimes become aware and even stand and watch minor crminal offences being commited , consciously deciding not to take action, assuming the risks and dangers of the consequences. This decision has to be sustained, on the one hand, on the level of proof already obtained i.e. consistent body of indicia or sufficient evidence and, on the other hand, on the predictability of the facts to occur, trough the consideration of relevant scenarios. We were able to verify that, altough, in most cases, the omission of action, can be lawfully permissible it can be superfluous in terms of production of evidence and, therefore, illegitimate and unsuitable. We came to the conclusion that operational factors and organizational culture have more influnece than one could expect on the decision process of one of the great actual challenges on what concernes criminal investigation: production of evidence vs social damage prevention and legality.
