Abstract(s)
A presente investigação centra-se nos Planos Individuais de Segurança, introduzidos no ordenamento jurídico nacional no ano de 2015, através da Lei n.º 129/2015, de 3 de setembro (Assembleia da República [AR], 2015b), que fixa o regime jurídico da prevenção da violência doméstica e da proteção e assistência das suas vítimas.
Um Plano Individual de Segurança consiste na elaboração de um conjunto de conselhos, recomendações e medidas de proteção pessoal, a definir individualmente com cada vítima, visando promover a sua segurança e minimizando o risco de revitimação.
A presente investigação possui natureza qualitativa, tendo sido empregue o método histórico, e o método inquisitivo, onde foi utilizado como procedimento de recolha de dados a realização das entrevistas.
Assim sendo, o presente estudo pretende responder à seguinte pergunta de partida: “Quais as medidas a ponderar na elaboração de um Plano Individual de Segurança destinado às vítimas de violência doméstica?”, tendo como objetivo central elencar um conjunto de contributos que permitam melhorar e adequar a atual forma de elaboração dos Planos Individuais de Segurança realizados pelos militares da Guarda Nacional Republicana.
Como principais conclusões verificou-se que atualmente os Planos Individuais de Segurança se encontram padronizados tendo em conta três situações distintas, podendo evoluir-se no sentido de uma maior individualização, com um maior envolvimento da vítima no processo da sua elaboração, e desenvolvendo medidas efetivas e específicas de segurança direcionadas a uma vítima em concreto. Deve ter-se também em consideração o perfil do agressor, os seus antecedentes, motivações e capacidades, assim como os potenciais meios de agressão a empregar, e fundamentalmente tendo em consideração os resultados da avaliação do risco de violência doméstica. Estes Planos Individuais de Segurança, sempre que possível, deverão também ser elaborados em rede, com a colaboração das demais entidades, públicas ou privadas, sendo fundamental a comunicação entre todos, com o objetivo de diversificar valências e obter sinergias. Por último verificaram-se algumas anomalias na plataforma digital para a elaboração dos Planos e constatou-se que a formação dos elementos que os elaboram se constitui como uma necessidade.
The present research focuses on the Individual Security Plans, introduced into the national legal system in the year of 2015, through the law number 129/2015, september 3rd (Assembleia da República [AR], 2015b), laying down the legal framework of the prevention of violence and the protection and assistance of victims. An Individual Security Plan consists in the elaboration of a set of advises, recommendations and personal protective measures, to be defined individually with each victim, in order to promote their safety and minimize the risk of revictimisation. The present investigation has a qualitative nature, having been used the historical method, and the inquisitive method, where it was used as data collection procedure the realization of the interviews. Thus, the present study intends to answer the following question: "What measures should be considered in the elaboration of an Individual Safety Plan for victims of domestic violence?", with the central objective of listing a set of contributions that allow improve and adapt the current form of elaboration of the Individual Security Plans carried out by the Republican National Guard military. As main conclusions it was found that currently the Individual Security Plans are standardized taking into account three distinct situations, and that may evolve in the direction of greater individualization, with greater involvement of the victim in the elaboration process, and developing effective and specific security measures directed to a concrete victim. It should also been taking in consideration the profile of the aggressor, his background, motivations and capabilities, as well as potential means of aggression to employ, and fundamentally taking into account the results of the evaluation of the risk of domestic violence. These Individual Security Plans, if possible, should also be elaborated in network, in collaboration with other entities, public or private, being fundamental the communication between all entities, with the aim of diversifying Valances and obtain synergies. Finally, there were some anomalies on the digital platform for the preparation of the Plans and it was verified that the formation of the elements that elaborate them is an need.
