Blackwater USA, DynaCorp International, Triple Canopy, Aegis Defense Services, Erinys International e Armor Group International são algumas das Empresas Militares Privadas, que operam no Iraque e no Afeganistão, tendo como nicho de mercado a segurança.
A proliferação de Empresas Militares Privadas surge após o fim da Guerra Fria e, desde então têm tido a atenção dos meios de comunicação social. Estas empresas são entidades comerciais, contratadas por uma miríade de actores que abrangem desde governos legítimos, Organizações Internacionais, Organizações Não Governamentais e outros. Publicitam abertamente as suas actividades. Procuram o lucro «empresarial» e não o lucro individual como forma de «estar» no mercado da segurança.
As capacidades que representam colocam-nas no centro do debate que passa, necessariamente, pela privatização de uma das funções de Estado. Sendo a tónica colocada no receio deste deixar de ser o detentor do monopólio da força, com todas as implicações que esta consideração poderá representar ao nível das Relações Internacionais.
Este estudo pretende investigar as implicações que as Empresas Militares Privadas produzem, actualmente, como novo elemento nas Relações Internacionais procurando identificar a sua finalidade, enquadramento jurídico, forma de actuação e perspectivar formas de evolução expectável perante o actual Sistema Internacional. Procura sobretudo analisar quais os efeitos que produzem nas interacções entre os actores do Sistema Internacional.
Nesse sentido, estabelecer-se-á inicialmente o estado da arte relativamente uma breve retrospectiva histórica que percorrerá a génese do mercado militar privado até ao nossos dias, procurar-se-á desmistificar as diferenças entre Empresas Militares Privadas e mercenários, e identificar quais as razões que levaram à emergência destas empresas. Procurar-se-á, consecutivamente, reconhecer quais as implicações que as Empresas Militares Privadas produzem ao nível da segurança internacional, qual a eficácia do quadro normativo, doméstico e internacional, na actualidade e através do estudo de caso da Blackwater USA, validar as reflexões anteriormente descritas. De seguida, através da análise da actual conflitualidade e do quadro normativo vigente, avaliar-se-á uma possibilidade de evolução do mercado militar privado.
Concluir-se-á, como é objectivo do trabalho, sobre a forma de como as Empresas Militares Privadas se apresentam como factor de influência nas relações internacionais, sugerindo propostas de futuras investigações decorrentes das conclusões do presente estudo. Private military companies emerged after the end of the Cold War, and since then have had the attention of the world media. These firms are enterprise entities, contracted by the different actors of the International Community, ranging from legitimate Governments to International Organizations and Non Governmental Organizations. They advertise their activity in the open market and search the corporate profit as a way to be in business.
The capabilities that this industry represents place private military companies in the center of the debate, where the discussion is about the privatization of one of the state functions. The focus is in the fear that states loose the monopoly of the use of force, with all the implications that this desideratum would represent at International Relations level.
This study investigates implications the private military companies’ poses as a new element within the International System, focusing on their objectives, legal boundaries, operating techniques and foreseeable evolution within this industry. The aim is to analyze the effects this industry has on the International Community.
This study will begin with a brief historical account that follows the emergence of this industry and establish the differences between the private military companies and mercenaries. Furthermore, it will identify the reasons that led to the emergence of the private military companies, afterwards it will identify the implications the private military companies pose to international security and evaluate what are the effects of domestic and international law. This will be validated with a study case on Blackwater USA. With the analysis of present’s day conflicts and law it will be accessed the trends of the private military industry.
In conclusion, this study will show that private military companies are an influence factor in the International Relations and suggesting future investigation in the continuity of this study.
