Abstract(s)
A problemática da violência doméstica tem merecido especial atenção nas últimas décadas,
num esforço para garantir maior proteção às inúmeras vítimas, em quem muitas das
respostas tem centrado a sua intervenção.
O acompanhamento dos comportamentos do agressor pode prestar um contributo relevante
para o garante desse objetivo. No entanto, existem dificuldades no acesso, por parte dos
investigadores criminais, à informação necessária para esse efeito. É necessária a criação
de automatismos de partilha de informação entre as entidades que abordam esta matéria,
para que esta chegue tempestivamente às forças de segurança, que lhes permitam
implementar as medidas ajustadas a cada situação.
Para esse desiderato há ainda que apostar na formação dos profissionais dedicados à
investigação deste ilícito, para os capacitar a efetivar uma adequada gestão do risco
associado a cada vítima.
Haverá ainda que considerar a alteração de alguns procedimentos relativos à
implementação do instrumento de avaliação de risco em uso, para que o mesmo seja a base
de todo o processo de gestão, tal como defende a literatura internacional consultada.
The problem of domestic violence has deserved special attention in the last decades, in an effort to ensure greater protection to the numerous victims, on whom many of the responses have focused their intervention. Monitoring the aggressor's behavior can make a relevant contribution to guarantee this goal. However, there are difficulties in the access to the information, necessary for this purpose, by criminal investigators. It is necessary to create automatic mechanisms to share information among the entities that deal with this matter, so that it reaches the security forces in a timely manner, allowing them to implement the measures adjusted to each situation. To this end, it is also necessary to invest in the training of professionals dedicated to the investigation of this crime, to enable them to carry out an adequate management of the risk associated to each victim. We should also consider changing some procedures regarding the implementation of the risk assessment tool in use, so that it can be the basis of the whole management process, as advocated in the international literature.
