Abstract(s)
Com a tendência atual de crescimento dos crimes de tipologia sexual torna-se
crucial para a investigação criminal uma aposta nas provas possíveis para
identificação do suspeito. A dentição humana, estando regida pelo princípio da
unicidade e pelas suas características, comporta então um caminho a percorrer,
uma vez que mordeduras são tipicamente usadas em casos mais violentos como
crimes sexuais. A presente dissertação reflete, neste sentido, sobre o tema da
Medicina Dentária Forense e tende a responder à pergunta de partida, como
podem as marcas de mordedura contribuir para a identificação do suspeito nos
casos de teor sexual. Como objetivo principal pretende-se perceber a
importância da Medicina Dentária Forense, com especial enfoque nas marcas
de mordedura para a identificação do suspeito enquadrado com os crimes de
teor sexual e como objetivos específicos, explicitar a Medicina Dentária Forense
e sua importância, descrever a classificação de marcas de mordedura para
identificação do suspeito, descrever os procedimentos na recolha da prova,
descrever e explicitar as limitações da identificação do suspeito através de
marcas de mordedura e enquadrar os crimes de teor sexual e respetivas penas.
Recorre-se deste modo a métodos qualitativos para produzir uma investigação
de caráter descritivo e, por fim, abordar um estudo de caso, ocorrido em Portugal,
procurando-se compreender um exemplo visando-se analisar e oferecer
perspicácia acerca de um tópico de maior abrangência. Concluiu-se, em
alinhamento com a literatura científica, que a Medicina Dentária Forense, através
de marcas de mordedura, pode contribuir para a descoberta da verdade material,
ainda que com limitações. Porém, pode ser tida como uma prova crucial
especialmente para situações em que a marca deixada seja a única prova do
crime. Embora não possa garantir com 100% de certeza que o suspeito é o autor
da marca, pode fornecer diferentes graus de certeza, restringindo o leque de
possíveis suspeitos.
With the current trend of growth in sexual typology crimes becomes crucial for criminal investigation a bet on possible evidence for identification of suspect. Human dentition, being governed by the principle of uniqueness and its characteristics, then behaves a path to travel, since biting are typically used in more violent cases as sexual crimes. The present dissertation reflects, in this sense, on the theme of forensic Dentistry and tends to answer the departure question, how can the bite marks contribute to the identification of the suspect in sexual content cases. As a general goal is intended to realize the importance of Forensic Dentistry, with special focus on biting marks for identification of suspect framed with sexual content crimes and as specific goals, explicit forensic dentistry and its importance, describe classification of bite marks for identification of suspect, to describe the procedures in collecting proof, describe and explain the limitations of identification of suspect through bite marks and frame sexual and respective feather crimes. It is appealed to this way to qualitative methods to produce a descriptive character investigation and finally, address a case study, occurred in Portugal, seeking to understand an example by aiming to analyze and offer acumen of a greater companion topic. It was concluded, in alignment with scientific literature, that Forensic Dentistry, through bite marks, may contribute to the discovery of material truth, if with limitations. However, it can be taken as crucial evidence especially for situations where the brand left is the only proof of the crime. While you can't guarantee with 100% certainty that the suspect is the author of the brand, you can provide different degrees of certainty, restricting the range of possible suspects.
