O problema colocado no presente estudo diz respeito à concretização do princípio nemo tenetur se ipsum accusare no direito contra-ordenacional português.
Começando da análise das garantias de defesa que a nossa Constituição assegura aos procedimentos sancionatórios e da intencionalidade do próprio direito contra-ordenacional, iremos verificar como aquele princípio se compatibiliza com os interesses de um processo, que se pretende célere e simplificado, com o núcleo de um direito historicamente sedimentado no universo penal.
Assim, pretendemos abordar vários problemas teórico-práticos, concluindo que o actual Regime Geral das Contra-Ordenações encontra nos próprios regimes específicos as soluções mais adequadas para dar resposta aos novos desafios que já não consegue corresponder.
The problem posed in this present study regards the “privilege against self-incrimination” fulfilment in the Portuguese Regulatory Offences Law. Beginning from the defense’s guarantees analysis that our Constitution ensures to penalty’s procedures and the intentionality of the Regulatory Law, we will see how that principle becomes compatible with the procedure’s objectives of simplification and swiftness with the right’s nucleus historically sedimented in the criminal universe. Therefore, we’re going to approach several technical and theoretical problems coming to the conclusion that the present general scheme of our Regulatory Offences Law finds in the specials schemes the most proper solutions to answer the new challenges that is unable to answer.
