Em 2018 o Departamento de Logística da Direção Nacional da Polícia de Segurança Pública
(PSP) criou o modelo de “Expressão de Necessidades” para formalização do início do
procedimento de formação de qualquer contrato público pela PSP.
O procedimento de formação dos contratos na contratação pública desenvolve-se através de
um conjunto de atos e formalidades, de modo geral, nos termos do Código dos Contratos
Públicos (CCP), aprovado pelo Decreto-Lei n.º 18/2008, de 29 de janeiro.
O n.º1 do artigo 36.º do CCP estabelece que o “procedimento de formação de qualquer
contrato inicia-se com a decisão de contratar, a qual deve ser fundamentada e cabe ao órgão
competente para autorizar a despesa inerente ao contrato a celebrar”.
Considerando que a PSP tem natureza de serviço público, e é dotada de autonomia
administrativa, através dos seus serviços orgânicos desenvolve procedimentos de
contratação pública, tendo estes, atualmente, origem numa expressão das suas necessidades.
Este trabalho irá debruçar-se sobre a importância do referido modelo de “Expressão de
Necessidades”, procurando perceber a relevância dessa formalização e do modelo
subjacente, que foi padronizado, e se esta estandardização se traduz numa potencialidade.
In 2018, the Logistics Department of the National Directorate of the Public Security Police (PSP) created an “Expression of Needs” template to formalize the beginning of the formation procedure of any public contract. The contract formation procedure in public procurement is carried out through a set of acts and formalities, generally under the Public Contracts Code (CCP), approved by Decree-Law No. 18/2008 of January 29. Article 36(1) of the CCP states that the "procedure for the formation of any contract begins with the decision to contract, which must be reasoned and is the responsibility of the body competent to authorize the expenditure inherent in the contract to be concluded". Considering that the PSP has a public service nature, and is endowed with administrative autonomy, through its organic services it develops public procurement procedures, which currently originate in an expression of its needs. This work will focus on the importance of the aforementioned template, seeking to understand the relevance of this formalization and the underlying model, which was standardized, and if this standardization translates into potential.
